Heard Mr. Mahindra Deshmukh, learned Advocate for the Applicants and Mrs. Megha Bajoria, learned A.P.P. for the State/Respondent.

Applicants are Accused Nos. 2, 5 and 6 in the crime bearing No. 17 of 2025 registered with Dhebewadi Police Station, TalukaKarad, District-Satara for the offence punishable under Section 140, 118(2), 118(1), 189, 191, 115, 352, 351(2), 352(3) and 126(2) of Bharatiya Nyaya Sanhita, 2023 ("BNS" for short). There are 8 accused involved in Crime No. 17 of 2025. 3.

Criminal Bail Application No. 168 of 2025 filed by the Applicants before the Court of Additional Sessions Judge at Karad, District-Satara was dismissed by an order dated 17th May 2025.

Mr. Mahindra Deshmukh, learned Advocate for the Applicants states that two other accused similarly and identically placed like that of the Applicants in context of the role alleged in the Crime No. 17 of 2025, have been released on bail. He states that parity be shown as the Applicants' role is similar to the role of two accused persons, who are enlarged on bail. 5.

Mrs. Megha Bajoria, learned A.P.P. for the State/Respondent fairly states that Accused Nos. 3 and 4 in Crime No. 17 of 2025 have been released on bail. She tenders copies of the orders dated 2nd May 2025 passed by the Court of Additional Sessions Judge at Kadad, District-Satara in Criminal Bail Application Nos. 152 of 2025 and 153 of 2025. The same are taken on record and marked as "X (Colly)" for identification. She states that the role of the said Accused Nos. 3 and 4 is similar to the role alleged against the present Applicants.

Mrs. Megha Bajoria, learned A.P.P. for the State/Respondent fairly states that the Applicants would be entitled to parity considering the order dated 2nd May 2025, referred to hereinabove and the role assigned to the Applicants herein in the crime. 7.

In view of the fair stand taken by the prosecution, as stated by Mrs. Megha Bajoria, learned A.P.P. for the State/Respondent, the present Application is allowed and the Applicants are secured by a pre-arrest bail on the following conditions :- a) In the event of arrest of the Applicants in Crime No. 17 of 2025 registered with Dhebewadi Police Station, TalukaKarad, District-Satara for the offence punishable under

Section 140, 118(2), 118(1), 189, 191, 115, 352, 351(2), 352(3) and 126(2) of BNS, they be released on PB and SB of Rs. 50,000/- (Rupees Fifty Thousand Only).

b) Applicants shall make themselves available for investigation, if any, as and when directed by the Investigating Officer. c) Applicants shall not interfere, influence or threaten the witnesses and shall not tamper with the prosecution evidence in any manner.

d) Applicants shall co-operate with the investigation. 8.

Anticipatory Bail Application No. 1474 of 2025 stands disposed of in the abovesaid terms.
