All these applications for anticipatory bail are arising out of one and the same crime. They are thus being disposed of by this common order.

The applicants are apprehending their arrest in Crime No.326 of 2025 registered at Ghatkopar Police Station, Mumbai for the offences punishable under Sections 3(5) and 316(4) of the Bharatiya Nyaya Sanhita, 2023.

The applicant in ABA No. 1584 of 2025, the applicant in ABA No.1961 of 2025 and the applicant in ABA No.1488 of 2025 were working as a Store Manager, Godown Incharge and Cashier respectively with Reliance Smart Bazar, Phoneix Market City, Ghatkopar(W), Mumbai. The allegations against the present applicants are of misappropriating goods worth Rs.1,19,38,315/- and cash of Rs.22,500/-.

I have heard the learned counsel appearing for the applicants and the learned APP for the respondent / State. 5.
Learned counsel for the applicants has drawn my attention to the various documents placed on record to show that the applicants have nothing to do with the alleged crime. It is further submitted that there is no need of custodial interrogation and the applicants are ready and willing to cooperate in the investigation. 6.
On the other hand, learned APP for the respondent/State submits that the applicants are involved in a serious crime of criminal breach of trust. It is submitted that considering the nature of crime, the applicants may not be released on anticipatory bail. 2/3

I have perused the statements of witnesses. From the said statements, prima facie, it is difficult to infer the involvement of the applicants in the alleged crime. There are no other criminal antecedents against the applicants. In that view of the matter, I am inclined to release the applicants on anticipatory bail. In the result, the following order is passed.
ORDER
A) The Applications are allowed.
B) In the event of arrest of the applicants in C.R. No..326 of 2025 registered at Ghatkopar Police Station, Mumbai for the offences punishable under Sections 3(5) and 316(4) of the Bharatiya Nyaya Sanhita, 2023, they be released on bail on executing P.R. Bond in the sum of Rs.25,000/- each with one surety or two sureties in the like amount. C) The applicants shall attend the concerned police station as and when called by the Investigating Officer and shall cooperate in the investigation.
