The learned Counsel for the applicant submits that the only allegation against the applicant is that he was present in the company of accused No.1 and other co-accused at the time of the incident. Furthermore, the offences punishable under Sections 78(2), 352, 118(1) and 115(2) of the Bhartiya Nyaya Sanhita, 2023, do not, by any stretch of interpretation, apply to the present applicant, as there are no specific allegations suggesting that he was involved in any act of stalking, physical assault, or causing any harm to any person. The learned Counsel also seeks leave to implead the first informant (XYZ) as party respondent to this application. Leave granted as prayed for. Necessary amendment shall be carried out forthwith. After the amendment is carried out, issue notice to the newly added respondent. The Investigating Officer to serve the notice.

By consent, stand over to 25 August 2025. In the meantime, the applicant shall attend the concerned police station on 23rd, 24th and 25th July 2025 between 11.00 a.m. and 2.00 p.m., surrender his mobile phone, and cooperate with the investigation.
