Heard Mr. Konde-Deshmukh, learned Counsel appearing for the Applicant and Mr. Metkari, learned APP for the State. 2.

By this application filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 ("BNSS"), the Applicant is seeking pre-arrest bail in connection with C.R. No.116 of 2025 registered with Lonawala Rural Police Station, for the offences punishable under Sections 318(4), 316(2), 352, 351(3) of the Bharatiya Nyaya Sanhita, 2023 ("BNS").

As per the prosecution case, the First Informant purchased the land which is of the ownership of the Applicant by registered Sale-deed, however, when the First Informant wanted to start the development, it transpired that the land, which has been shown is not the subject matter of the Sale-deed and therefore F.I.R. has been lodged. However, today both the learned Counsel appearing for the Applicant and the Respondent No.2 respectively state that the Applicant i.e. Accused and the Respondent No.2 i.e. the First Informant have settled the dispute. Both the learned Counsel tender Compromise Deed dated 17th July 2025.

A learned Single Judge has already protected the Applicant by Order dated 13th June 2025. The said protection is in operation for last about six months.

Thus, in the facts and circumstances, the case is made out fore grant of anticipatory bail to the Applicant. Hence, following Order is passed:

O R D E R

(i) In the event of arrest, the Applicant - Mr. Yashwant Ravji Mohol be released on bail in C.R. No.116 of

2025 registered with Lonavala Rural Police Station, on executing P.R. bond of Rs.30,000/- and furnishing one or two sureties in the like amount.

(ii) The Applicant shall attend the concerned Police Station as and when called by the Investigating Officer and shall co-operate with the investigation.

(iii) The Applicant shall furnish his cell phone number and residential address to the Investigating Officer and shall keep the same updated, in case of any change thereto.

(iv) The Applicant shall not directly or indirectly make any inducement, threat, or promise to any person acquainted with the facts of the case so as to dissuade such a person from disclosing the facts to the Court or to any Police personnel.

(v) The Applicant shall not tamper with the prosecution evidence and shall not contact or influence the Complainant, or any witness, in any manner.

The Anticipatory Bail Application is allowed and disposed of accordingly.
