This is an application for Anticipatory Bail. 2.

The applicant is apprehending his arrest in Crime No. 1021 of 2022 registered at Malad Police Station, for the offences punishable under Sections 406, 420, 465, 467, 468 & 471 read with 34 of the Indian Penal Code.

It is the case of the prosecution that the first informant is a businessman and as such due to the Covid lockdown he was looking out for new business opportunities. Accordingly, in December-2020, he found out that the present applicant and other co-accused were supplying nitrile gloves at reasonable rates. The 1/3

allegations against the present applicant and other co-accused are that they lured the first informant with an offer to supply nitrile gloves at lower rates than the market and induced him to pay them an amount of Rs.78,57,000/- for the same. However, they failed to supply the nitrile gloves as well as the said amount was not refunded to the first informant. Consequently, the present crime was registered.

I have heard the learned counsel for the applicant and the learned APP for the respondent-State.

The learned counsel for the applicant submits that the applicant has nothing to do with the alleged crime. It is submitted that the main allegations are against the co-accused Nisha Dusar. It is further submitted that the investigation is over and the prosecution has already filed the charge-sheet against the present applicant and other co-accused.

On the other hand, the learned APP for the respondentState submits that the applicant is involved in a serious offence of cheating and defrauding the first informant to the tune of Rs.78,57,000/-. It is submitted that the applicant is involved in one more crime of similar nature. It is submitted that considering the 2/3

nature of crime the applicant may not be released on anticipatory bail.

I have perused the charge-sheet. The main allegations are against the co-accused. The prosecution has filed chargesheet against the present applicant. In that view of the matter, I am inclined to release the applicant on anticipatory bail. In the result, the following order is passed :

O R D E R

a) The Application is allowed.

b) In the event of arrest of the applicant in connection with Crime No. 1021 of 2022 registered at Malad Police Station, for the offences punishable under Sections 406, 420, 465, 467, 468 & 471 read with 34 of the Indian Penal Code, the applicant be released on bail on furnishing P.R. Bond in the sum of Rs. 25,000/- with one or two sureties in the like amount.

c) The applicant shall not commit any other crime.
