Heard Mr. Rokade, learned Counsel appearing for the Applicant and Ms. Yadav, learned APP for the State. 2.
This application is filed under Section 438 of the Code of Criminal Procedure, 1973 ("CrPC") seeking pre-arrest bail in connection with C.R. No.32 of 2024 registered with Ozhar Police Station, Nashik Rural, for the offences punishable under Sections 353, 354, 427, 504 and 506 read with Section 34 of the Indian Penal Code, 1860.

As per the prosecution case when the employees of Maharashtra State Electricity Distribution Company were discharging their duties and as the electricity bill was not paid, the electricity connection of the subject property was disconnected, the Accused assaulted the injured and also outraged the modesty of the victim. Accused No.1 i.e. the present Applicant is the father and Accused Nos.2 and 3 are his sons. The Applicant is senior citizen of 60 years and a retired person.

The Applicant Nos. 2 and 3 were arrested and released on bail. The Charge-sheet is filed on 30th December 2024. There are no other criminal antecedents.

Although learned APP strongly opposes the application, it is admitted position that the Charge-sheet is filed and investigation is completed. Accordingly, the case is made out for grant of anticipatory bail to the Applicant. Hence, following Order is passed:
O R D E R
(i) In the event of arrest, the Applicant - Shankar Nimbaji Dabhade be released on bail in C.R. No.32 of 2024 registered with Ozhar Police Station, Nashik Rural, on
executing P.R. bond of Rs.25,000/- and furnishing one or two sureties in the like amount.
(ii) The Applicant shall attend the concerned Police Station as and when required by the Investigating Officer.
(iii) The Applicant shall furnish his cell phone number and residential address to the Investigating Officer and shall keep the same updated, in case of any change thereto.
(iv) The Applicant shall not directly or indirectly make any inducement, threat, or promise to any person acquainted with the facts of the case so as to dissuade such a person from disclosing the facts to the Court or to any Police personnel.
(v) The Applicant shall not tamper with the prosecution evidence and shall not contact or influence the Complainant or any witness, in any manner.

The Anticipatory Bail Application is allowed and disposed of accordingly.
