This is an application for Anticipatory Bail. 2.

The applicants are apprehending their arrest in Crime No. 391 of 2025 registered at Dahisar Police Station, for the offences punishable under Sections 305, 61(2) and 3(5) of the Bharatiya Nyaya Sanhita, 2023.

The applicant Nos.1 and 2 are the daughter and son-inlaw of the first informant. The allegations against the applicants 1/3

are of theft. It is alleged that they stole certain gold ornaments and cash of Rs.2,70,000/- from the house of the first informant. 4.

I have heard the learned counsel for the applicants and the learned APP for the respondent-State.

The learned counsel for the applicants submits that against the wishes of the first informant, the applicant No.1 has solemnised the marriage with the applicant No.2. It is submitted that thus false allegations are made against them. It is submitted that the applicants are ready and willing to co-operate in the investigation.

On the other hand, the learned APP for the respondentState submits that considering the nature of crime, the applicants may not be released on anticipatory bail.

I have perused the First Information Report. Prima-facie, there appears to be substance in the submission of the learned counsel for the applicants. In that view of the matter, I am inclined to release the applicants on anticipatory bail. In the result, the following order is passed :

a) The Application is allowed.

b) In the event of arrest of the applicants in connection with Crime No. 391 of 2025 registered at Dahisar Police Station, for the offences punishable under Sections 305, 61(2) and 3(5) of the Bharatiya Nyaya Sanhita, 2023, the applicants be released on bail on furnishing P.R. Bond in the sum of Rs. 25,000/- each with one or two sureties in the like amount.

c) The applicants shall attend the concerned police station as and when called by the investigating officer and shall co-operate in the investigation.
