This application is filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 seeking pre-arrest bail in connection with C.R. No.429 of 2025 registered with Satana Police Station, Nashik, for the offences punishable under Sections 189(2), 189(4), 190, 191(2), 193(3), 115(2), 118(1), 74, 76, 324(4), 329(3), 351(2) and 352 of the Bharatiya Nyaya Sanhita, 2023.

The learned Additional Sessions Judge, Malegaon, Dist. Nashik by order dated 16th June 2025 passed in Criminal Bail Application No.536 of 2025 rejected the anticipatory bail of the present Applicants. The prosecution case is set out in paragraph Nos.3 and 4 of the said order dated 16th June 2025, which reads as under:

"3. It is case of prosecution that informant is woman of 55 years old. She has lodged complaint/report on 08.06.2025. She alleged that she is residing with her husband, father-in-law, son, daughters-in- law, grandson and granddaughter. They are agriculturist. The dispute is going on regarding agricultural land gat No. 87/2 and 88 situated at Dangsaundane between her family and Hemant Chandratre.

4. On 08.06.2025 at about 8.00 a.m. informant and her family members were in gat No. 88 and 89 to sow the seeds. At about 11.30 a.m. accused Hemant Chandratre with 10 to 12 persons came there by innova car No. MH 15-DS 6186 and ford car No. MH 02-BT-4210. Out of them 7 to 8 were male and 2 to 3 were female. They came with sticks in their hand. Accused Sumit Chandratre stated to the complainant and her family members that the said land is belonging to him. He started abusing them in filthy words. They beaten elder son of informant namely Amol by fists and kicks. Hence, informant and her husband try to rescue him but they have beaten husband of complainant by means of fists and kicks. Accused Sumit has pushed the informant by giving fist blow on her chest. Thus, she fallen on the ground. At that time accused Sumit sat on her chest and beaten her. He has pushed her saree and

thereby naked her. At that time her both son have rescued her from him. While she was wearing saree, three female which were with them have beaten the informant by fists and kicks. During the said incident the gold Mangalsutra of informant has been lost. At that time son of informant namely Sagar was driving tractor in the said land. All accused have assaulted Sagar by means of sticks, fists and kicks blow. Laborer were present and they witnessed the incident. Accused has also abused and threatened them. Accused have damaged the CCTV Cameras and tractor of informant by means of sticks and stones. They also damaged the pipeline, cable and compound angles of informant. They threatened to kill informant and her family members."

Perusal of the record shows that there is dispute between both the parties with respect to the agricultural lands. It appears that there are cross complaints against each other. 5.

A learned Single Judge by order dated 7th August 2025 has already granted interim protection. Prima facie, the incident in question took place on a spur of moment as the civil dispute is pending between the parties. The injuries are simple in nature. 6.

Accordingly, the case is made out for grant of Anticipatory Bail. In view thereof, the following order is passed:

O R D E R

(a) In the event of arrest of the Applicant No.1-Sumedh Hemant Chandratre, the Applicant No.2-Hemant Shashikant Chandratre and the Applicant No.3Nishigandha Hemant Chandratre in connection with C.R. No.429 of 2025 registered with the Satana Police Station, Nashik, the Applicants are directed to be released on bail on their furnishing P.R. Bond in the sum of Rs.25,000/- each with one or two solvent sureties each in the like amount.

(b) The Applicants shall attend the concerned Police Station on every Sunday between 11:00 a.m. to 01:00 p.m. till filing of the chargesheet and shall cooperate with the investigation. In addition, the Applicants shall attend the concerned Police Station as and when called.

(c) The Applicants shall furnish their cell phone number and residential address to the Investigating Officer and shall keep the same updated, in case of any change thereto.

(d) The Applicants shall not directly or indirectly make

any inducement, threat, or promise to any person acquainted with the facts of the case so as to dissuade such a person from disclosing the facts to the Court or to any Police personnel.

(e) The Applicants shall not tamper with the prosecution evidence and shall not contact or influence the Complainant or any witness in any manner.
