By this application, applicant is seeking anticipatory bail in Crime No.139 of 2025 registered with Shahupuri Police Station, District: Satara for the offences punishable under Section 420 read with Section 34 of the Indian Penal Code.

The prosecution case in short is that during period between 25.10.2010 to 07.07.2018, present applicant in collusion with other co-accused cheated the depositors including informant to the tune of Rs.10,86,200/- by falsely inducing them to invest the amount and by assuring them that, if they invest in their company, the company will provide plot or row house to the depositor within Mumbai and other surrounding area and thereby committed the offence.

Heard learned Advocate for Applicant, learned APP for the Respondent-State instructed by Investigating Officer. Perused the record.

It is the case of applicant that he himself is victim of the fraud committed by Origin Leisure Clubs Private Limited, wherein he has invested an amount of Rs.21,00,000/-. He had also approached Economic Offences Wing (EOW) making complaint against the said perpetrators. On 22.02.2018, the applicant received summons from the EOW to appear along with documents within three days from the date of receipt of the said letter. By letter dated 27.03.2019, the applicant was informed that his complaint is transferred to Naupada Police Station and he should attend the said police Station as and when called by them. He had also issued legal notice to the said company and its proprietors on 02.06.2018. The applicant is working as Assistant Teacher in Abhinav Vidya Mandir Secondary, Kandivali (West), Mumbai. The informant and witnesses have alleged that the amount of Rs.3,37,200/- was paid in cash to the applicant and the remaining amount was transferred online in the name of said company.

Perusal of First Information Report and investigation papers reveal that the informant and witnesses have alleged that during the period from 25.10.2010 to 07.07.2018 they have invested amounts

with the said company at the insistence of applicant. The FIR is lodged on 05.05.2025.

The applicant was directed to attend the Police Station and cooperate in the investigation. He has accordingly attended the police station. From the record prima facie there does not appear sufficient material showing the involvement of the applicant in the present crime. In these peculiar facts and circumstances of the case, custodial interrogation of the applicant is not necessary. The application is therefore allowed.

In the event of arrest of applicant - Tulsiram @ Tulshidas Ramchandra Pisal in Crime No.139 of 2025 registered with Shahupuri Police Station, District: Satara, he be released on bail on executing Personal Bond in the sum of Rs.15,000/- with one surety in the like amount.

The Applicant shall attend the concerned police station as and when called by the Investigating Officer. 9.

The Applicant shall not tamper with the prosecution evidence.
