The learned Counsel for the applicant submits that there has been an inordinate and unexplained delay in the registration of the FIR, which casts serious doubt on the credibility and authenticity of the prosecution's case. He further submits that the applicant has not been named in the FIR, nor was he aware of the alleged acts forming the basis of the prosecution's case. Further the learned Counsel brought to the attention of this Court that a civil suit concerning the same subject matter is presently pending adjudication between the parties. Chitra Sonawane 10-aba-1682-25.doc concluded, a charge sheet has been filed against the coaccused and no further investigation is pending insofar as the applicant is concerned. The learned Counsel submits that all the material evidence relied upon by the prosecution is purely documentary in nature and is already in its possession. As such, there is no necessity for custodial interrogation of the applicant.

The learned APP, however, seeks an accommodation as the investigating officer is not present and assured the Court that the applicant will not be arrested in the present crime till the next date.
