By this application filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 ("BNSS"), the Applicant is seeking pre-arrest bail in connection with C.R. No.83 of 2025 registered with Wakad Police Station, Pimpri-Chinchwad, for the offences punishable under Sections 316(2), 318(4), 336(2), 336(3), 338,
340(2), 341 r/w 3(5) of the Bharatiya Nyaya Sanhita, 2023 ("BNS").

It is the submission of Mr. Gadhavi, learned Counsel for the Applicant that the Applicant is not involved in the crime. In any case, he submits that the Applicant is ready to co-operate with the investigation. He states that although there are antecedents, they are of the year 2018-2019.

On the other hand, Mr. Mangaonkar, learned APP and Mr. Ganbavale, learned Counsel for the First Informant strongly opposes the Application. Both of them submit that the offence is very serious where the forged and fabricated Will of the grandfather of the First Informant deceased- Sopan Kalate was prepared. Mr. Ganbavale, learned Counsel for the First Informant points out Certificate, which is annexed along with said Will on page-39 and submits that perusal of said certificate clearly shows that the said certificate is forged and fabricated. 5.
Perusal of record shows that as per the prosecution case, the Applicant and other Accused prepared forged and fabricated Will of the First Informant's grandfather- Sopan Kalate and same has
also been registered. Perusal of record particularly medical certificate (page-39) clearly shows that the offence is very serious and the Applicant is prima facie involved in very serious crime. However, the offence has taken place in the year 1999. Thus, after a period of 27 years, no useful purpose will be served by custodial interrogation.

Accordingly, in the facts and circumstances, case is made out grant of Anticipatory Bail. Hence, following Order is passed:
O R D E R
(i) In the event of arrest, the Applicant - Dilip Sopan Kolate be released on bail in C.R. No.83 of 2025 registered with Wakad Police Station, PimpriChinchwad, on executing P.R. bond of Rs.1,00,000/- and furnishing one or two solvent sureties in the like amount.
(ii) The Applicant shall attend the concerned Police Station on 22nd January 2026, 23rd January 2026 and 24th January 2026 between 11.00 a.m. to 2.00 p.m. and thereafter on 1st Sunday and 3rd Sunday of each month and shall co-operate with the investigation.
(iii) The Applicant shall furnish his cell phone number and residential address to the Investigating Officer and shall keep the same updated, in case of any change thereto.
(iv) The Applicant shall not directly or indirectly make any inducement, threat, or promise to any person acquainted with the facts of the case so as to dissuade such a person from disclosing the facts to the Court or to any Police personnel.
(v) The Applicant shall not leave India without prior permission of the Court.
(vi) The Applicant shall not tamper with the prosecution evidence and shall not contact or influence the Complainant, or any witness, in any manner.

The Anticipatory Bail Application is allowed and disposed of accordingly.
