Heard Ms. Radhikha Kurdukar, learned Amicus Curiae appointed to represent the Applicant, Mr. Pathan learned Counsel appearing for the Applicant and Mr. Karmakar, learned APP appearing for the Respondent-State.

On 06th October 2025 as none has appeared for the Applicant, to give one more opportunity to the Applicant, matter was adjourned to 07th October 2025. On 07th October 2025 also none has represented the Applicant and therefore, Ms. Radhika

Kurdukar, learned Counsel of this Court has been appointed as Amicus Curiae to represent the interest of the Applicant and the matter was adjourned to 09th October 2025. Learned Amicus Curiae tenders a detailed written note concerning the relevant aspects.

Today, Mr. Pathan, learned Counsel appearing for the Applicant is present and he states that inadvertently the listing of the matter was not noticed and therefore he could not remain present in the Court.

At the outset learned APP states that there are four Antecedents and the details of the same are not mentioned in the Anticipatory Bail Application.

In view of the said contention raised by learned APP, Mr. Pathan, learned Counsel appearing for the Applicant seeks withdrawal of the Anticipatory Bail Application. He states that the fresh Anticipatory Bail Application will be filed by giving particulars of the antecedents.

Accordingly, the Anticipatory Bail Application is allowed to be withdrawn with leave as sought.

This Court places on record the appreciation of the assistance rendered by Ms. Radhika Kurdukar, learned Amicus Curiae.
