Learned Counsel for the applicant submits that the panchnama of the alleged incident lacks the signatures of the panchas, who explicitly refused to sign it. Furthermore, the affidavit submitted by the owner of Soham Automobile & Tractor Garage indicates that the applicant's tractor was under repair at the relevant time. The learned Counsel further submits that the informant is not an eyewitness to the incident, and there are no witnesses linking the applicant's tractor to the alleged incident.
