By the present Anticipatory Bail Application filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the Applicant is seeking pre-arrest bail in connection with CR No.195 of 2025 registered with the Chandannagar Police Station, Pune
City, for the offences punishable under Sections 120B, 471, 468, 467 and 420 of the Indian Penal Code, 1860 ("IPC"). 3.
The prosecution case is set out in Paragraph Nos.2 to 4 of the common Order dated 16th June 2025 passed by the learned Additional Sessions Judge, Pune inter alia in Criminal Bail Application No.3448 of 2025 filed by the present Applicant, which reads as under:

Brief facts of the prosecution case are as under : The complaint is lodged by Smt. Swati Khedkar, Police Inspector, Crime Branch that since March 2025, she attached with Chandannagar Police Station. After joining Chandannagar Police Station one Crime No. 207/2023 which was investigated previously by Anil Mane, the then Police Inspector was handed over to Police Inspector Swati Khedkar. It was transpired that Senior Police Inspector Smt. Dhakne, had investigated Crime No. 207/2023 and on 24/4/2025, she had filed say before Hon'ble High Court in Writ Petition for quashing of FIR was filed and communicated that B Summary has been filed in said crime. Therefore that writ was disposed of.
Allegations in this crime is that when it was revealed that earlier crime was false of which FIR was lodged by one Anand Lalasaheb Bhagat who is co-accused in this case. Police further took search of Anand Bhagat and on 15/5/2025 in house search of Anand Bhagat some false documents were found.
Verma are involved in this crime. So investigation to that effect was carried out.

It is case that the property bearing Gat No.2262 situated at Wagholi, Pune was standing in the name of Aparna Verma. One document i.e. one sale deed bearing Sr.No.4860/2023 was executed by Aparna Verma resident of Islampur, Tal. Walva, District Sangli in favour of one Anand Bhagat and Shailesh Thombre. It is further case of the prosecution that Aparna Verma is resident of Islampur, District Sangli is the fake lady. In fact her name is Archana Patekar. Property in whose name is standing is Aparna Verma who is residing at Dubai. After purchase of land from fake Aparna Verma, Anand Bhagat filed FIR against Aparna Verma, resident of Dubai that she has prepared false document and falsely claiming right over the property. Accordingly Crime No. 207/2023 was registered and in that investigation it is found that she is the true owner. Therefore B Summary was filed against her.

Further it is prosecution case that applicant Rajendra Landge was then Senior Police Inspector at Chandannagar Police Station. Shailesh Thombre who purchased land from fake Aparna Verma alongwith Anand Bhagat is his brother-in-law and he involved in this crime and by creating conspiracy to grab land worth Rupees in crores, this fake Aparna Verma was brought before and got executed false document in favour of Anand Bhagat and Shailesh Thombre. Therefore Seema Khedkar, PI, Chandannagar Police Station lodged FIR against all these persons and aforesaid crime was registered for the above mentioned offences. Both the applicants had claimed for anticipatory bail." 4.
It is the submission of Mr. Bhanushali, learned Counsel for the Applicant that the main allegation is that one Aparna Verma from Sangli represented that she was Aparna Verma from Dubai
and the property of said Aparna Verma from Dubai has been sold to the present Applicant. He submits that thereafter Special Civil Suit No.1875 of 2022 was filed in the District Court at Pune by Aparna Yashpal Verma from Dubai and the present Applicant i.e. Shailesh Sadashiv Thombare has been made party to the said Suit. The said Suit was compromised by filing the Consent Terms dated 17th February 2025. The Consent Terms dated 12th December 2024 were executed with the present Applicant and an amount of Rs.1,50,00,000/- were paid to the present Applicant. He further submits that thereafter the subject FIR being CR No.195 of 2025 was lodged by the Police Inspector of Chandannagar Police Station, Pune City. He, therefore, submits that custodial interrogation is not necessary.

Mr. Mithe, learned Counsel for the First Informant in FIR No.257 of 2025, submits that the First Informant has already compromised with the present Applicant, and, therefore, he will not be opposing granting anticipatory bail to the Applicant. 6.
Ms. Mulekar, learned APP, for the Respondent-State of Maharashtra, states that the offence is very serious, as the
Applicant is party to a fake Sale-Deed and thereafter accepted huge consideration by executing the Consent Terms dated 12th December 2024 which were filed in Special Civil Suit No.1875 of 2022.

Perusal of the record shows that affected party i.e. Aparna Yashpal Verma from Dubai has already settled the dispute with the present Applicant in Civil Court and paid an amount of Rs.1,50,00,000/- to the present Applicant and executed the Consent Terms dated 12th December 2024 and the same were filed in Special Civil Suit No.1875 of 2022. The subject FIR has been filed by the Police Inspector of Chandannagar Police Station, Pune City. Thus, in the facts and circumstances, custodial interrogation is not necessary.

Thus, the case is made out for grant of anticipatory bail. In view thereof, the following Order is passed:
O R D E R
(a) In the event of arrest of the Applicant - Shailesh Sadashiv Thombare, in connection with CR No.195 of 2025 registered with the Chandannagar Police
Station, Pune City, he be released on bail on his furnishing PR Bond in the sum of Rs.1,00,000/- with one or two solvent sureties in the like amount. (b) The Applicant shall attend the concerned Police Station on 20th February 2026 and 21st February 2026 between 11:00 am to 02:00 pm and thereafter once in 15 days i.e. on the first and the third Sunday of every month between 11:00 am to 02:00 pm, and shall cooperate with the investigation.
(c) The Applicant shall furnish his cell phone number and residential address to the Investigating Officer and shall keep the same updated, in case of any change thereto.
(d) The Applicant shall not directly or indirectly make any inducement, threat, or promise to any person acquainted with the facts of the case so as to dissuade such a person from disclosing the facts to the Court or to any Police personnel.
(e) The Applicant shall not tamper with the prosecution evidence and shall not contact or influence the
Complainant or any witness in any manner.
(f) The Applicant shall deposit the passport with the Investigating Officer.
(g) The Applicant shall not leave India without prior permission of the learned Trial Court/Sessions Court. 9.
