It is the prosecution's case that on 19th May 2025, applicant and co-accused kidnapped the first informant and sexually assaulted her.

It is the contention of learned counsel for applicant that applicant has been falsely implicated in this case. There is delay of 9 days in lodging F.I.R. Learned counsel further submitted that on 27th May 2025, F.I.R. was lodged by co accusedRajkumar Londhe against husband of the first informant alleging that they tried to kill him. After lodging F.I.R., present F.I.R. is lodged against the applicant and co-accused only to encounter the said crime. Hence, requested to allow the application.

It is the contention of learned APP alongwith learned counsel for respondent no. 2 that applicant and co-accused kidnapped the first informant in their car and sexually assaulted her by taking turns. The nature of offence is grievous. Considering the allegations against the applicant, his custodial interrogation is required and requested to reject the application. 5.

I have heard all the learned counsel, perused F.I.R. and documents produced on record. It appears from the record that on 26th May 2025, co-accused Rajkumar Londhe lodged the complaint against husband of the first informant alleging that husband of the first informant in the present case and her 2/4

accomplice assaulted him with sharp weapon with intention to kill him on 19th May 2025. Thereafter, present F.I.R. is lodged by the first informant alleging that on 19th May 2025, applicant and co-accused abducted the first informant and sexually assaulted her. There is delay of 9 days in lodging the complaint. Co-accused has lodged F.I.R. against the husband of the first informant. It shows, to encounter earlier F.I.R., present F.I.R. is filed.

Considering these facts, I pass following order:

O R D E R

I.

In the event of arrest, applicant be enlarged on bail in C.R. No. 93/2025 registered with Madha Police Station, Dist. Solapur on furnishing P.R. Bond in the sum of Rs. 20,000/- with one or two sureties in the like amount.

II.

The applicant shall attend the concerned police station as and when required.

III.

The applicant shall not tamper with the evidence or attempt to influence or contact the complainant, witnesses or any person concerned with the case.
