Heard Mr. Yadav-Patil, learned Counsel appearing for the Applicant and Ms. Yadav, learned APP for the State. 2.

This Application is filed under Section 438 of Code of Criminal Procedure, 1973 seeking pre-arrest bail in connection with C.R. No.425 of 2024, registered with Shikrapur Police Station, Pune Rural, for the offences punishable under Sections 143, 147, 148, 149, 307, 427, 341, 323, 504, 506 of the Indian Penal Code, 1860.

As per the prosecution case, the dispute started between the First Informant, others and Accused on account of overtaking the vehicle and obstructing way.

It is the submission of Mr. Yadav-Patil, learned Counsel for the Applicant that in fact the Applicant was not present when the incident took place and as his father is Police Patil, he has been called to resolve the dispute between two groups i.e. the group of the First Informant and group of the Accused. He submits that the Applicant is not involved in the crime. He further submits that there are no antecedents. He submits that the Charge-sheet is already filed.

On the other hand, Ms. Yadav, learned APP strongly opposes the Application. She submits that the Applicant is involved in the crime and the crime is very serious.

Perusal of record shows that the dispute started on the spur of moment on account of overtaking the vehicle and obstructing its vehicle and some verbal altercation took place due to the same and thereafter the incident of assault has taken place. The Charge-sheet is already filed. The injures are simple in nature. The other Accused have already been released on bail. There are no other antecedents.

Accordingly, by imposing certain conditions, the Application can be granted. Hence, following Order is passed:

O R D E R

(i) In the event of arrest, the Applicant- Krushnaji Dnyanoba Virole be released on bail in C.R. No.425 of 2024, registered with Shikrapur Police Station, Pune Rural, on executing P.R. bond of Rs.25,000/- and furnishing one or two sureties in the like amount. (ii) The Applicant shall attend the concerned Police Station as and when called by the Police and shall cooperate with the investigation. (iii) The Applicant shall furnish his cell phone number and residential address to the Investigating Officer and shall keep the same updated, in case of any change thereto.

(iv) The Applicant shall not directly or indirectly make any inducement, threat, or promise to any person acquainted with the facts of the case so as to dissuade such a person from disclosing the facts to the Court or to any Police personnel.

(v) The Applicant shall not tamper with the prosecution evidence and shall not contact or influence the Complainant, or any witness, in any manner.

The Anticipatory Bail Application is allowed and disposed of accordingly.
