Leave to implead the first informant as party respondent to this application. Amendment shall be carried out within one one week from today. After the amendment is carried out, issue notice to the newly added respondent. 2.
The learned Counsel for the applicant submits that the applicant has been falsely implicated in the present crime with malicious intent. He submits that the FIR has been lodged not as a genuine complaint, but rather as a means to exert undue pressure on the applicant. Chitra Sonawane 928-aba-1889-25.doc withdraw or refrain from pursuing an earlier FIR, which was registered prior in point of time and directed against the present informant. He further submits that there exists a long standing civil dispute between the applicant and the informant concerning a piece of disputed property, and that litigation in this regard has been ongoing for the past ten years. The present criminal proceedings are, therefore, alleged to be an abuse of the process of law and a continuation of the civil dispute by other means. 3.
The learned APP seeks an accommodation as the investigating officer is not present and makes a statement that the applicant will not be arrested in the present crime until the next date.
