By this application, the applicant seeks pre-arrest bail in connection with CR No.60 of 2025, registered with Bhor Police Station, Pune Rural, for offences punishable under Sections 498A, 313, 324, 323, 504, 506, 342, 143, 147, 148 and 149 of the Indian Penal Code.

Mr PB Gujar, the learned Counsel appearing on behalf of the applicant, and Ms Pratibha Shelake, the learned Counsel appearing for respondent No.2, jointly submit that the informant/ wife and the applicant/ husband have resolved their dispute amicably. The learned Counsel for respondent No.2 submits that due to a misunderstanding and arguments in the matrimonial life, respondent No.2 filed the present FIR. The dispute between the parties has been resolved with the assistance of family members, and the informant and the applicant desire to continue living together. The learned Counsel further submits that respondent No.2 has no grievance against the applicant and expresses her consent to grant pre-arrest bail to the Page No. 2 of 4

Chitra Sonawane 904-aba-1912-2025.doc applicant. To this effect, respondent No.2 has executed a consent affidavit dated 11 August 2025. The same is taken on record and marked as 'X' for identification. 4.

Mr Anand Shalgaonkar, the learned Additional Public Prosecutor representing respondent No.1/ State, on instructions, submits that the investigation has concluded, nothing is to be recovered or discovered from the applicant, and a charge sheet has been filed against the co-accused. He submits that in light of the compromise, appropriate orders may be passed.

Upon perusing the records, the genesis of the offence appears to be matrimonial. The parties have now arrived at a settlement regarding their dispute, and respondent No.2 consents to granting anticipatory bail to the applicant. The contesting parties are present before the Court and are identified by their respective Counsel. When questioned, respondent No.2 expresses no objection, consents to granting pre-arrest bail to the applicant, and reiterates the contents of her consent affidavit dated 11 August 2025. Furthermore, with the investigation concluded and culminating in a charge sheet, nothing is to be recovered or Page No. 3 of 4

Chitra Sonawane 904-aba-1912-2025.doc discovered from the applicant. Given these circumstances, this Court is inclined to exercise its discretion in favour of the applicant. Hence, the following order:

ORDER

(i) In the event of the applicant's arrest in CR No.60 of 2025, registered with Bhor Police Station, Pune Rural, he shall be released on bail upon executing a PR Bond of Rs.25,000/- and furnishing one or more sureties in the like amount.
