This is an application for Anticipatory Bail. 2.

The applicant is apprehending his arrest in Crime No. 611 of 2024 registered at Hill Line Police Station, Dist-Thane, for the offences punishable under Sections 118(1), 329(4), 125(a), 189(2), 324(2), 308(4), 190, 191(2) and 352 of the Bhartiya Nyaya Sanhita, 2023.

It is the case of the prosecution that on 04.08.2025, the present applicant and other co-accused were threatening the 1/3

informant's brother with a knife in order to extort money from his Chinese food shop. At that time, the informant reached the spot, upon seeing him, the applicant and other co-accused demanded money from him. Thereafter, the applicant and other co-accused abused and assaulted the informant and his brother with iron utensils from the shop as well as caused damage to the informant's office and his brother's shop. It is alleged that the applicant and co-accused Jayesh Bhamre are released on bail in a crime under Section 302 of the Indian Penal Code and as such they terrorize the people in their vicinity to extort money from them.

I have heard the learned counsel for the applicant and the learned APP for the respondent-State.

The learned counsel for the applicant submits that the applicant has nothing to do with the alleged crime. It is submitted that the investigation is almost over.

On the other hand, the learned APP for the respondentState submits that the injured sustained three grievous injuries. It 2/3

is submitted that the present applicant has assaulted with iron utensils. The learned APP further submits that the applicant is involved in three more crimes of serious nature, including Section 302 of the Indian Penal Code. It is submitted that the applicant is absconding after the registration of the present crime. 7.

I have perused the injury certificate. The injured has sustained three grievous injuries. Considering the overall facts and circumstances of the case, I am not inclined to release the applicant on anticipatory bail. The application is rejected. [N.R.BORKAR, J.] 3/3
