By this application, applicants Swapnali Mukund Jadhavar, Sakhubai Hanmant Jadhavar, Rajaram Vitthal Kharat, Ajit Vishnu Dalvi and Vijay Shailendra Karad seek anticipatory bail in Crime No. 459 of 2024, registered with Vishrambag Police Station, Sangli for the offences punishable under Sections 316(2), 318(4) read with Section 3(5) of the Bharatiya Nyaya Sanhita, 2023.

The prosecution's case in short is that the first informant is one Ravindra Balaso Kulkarni. He is Assistant Vice President of HDFC Bank Limited. He alleged that in November 2022, the Chief Execution

Officer Mukund Jadhavar and six directors of Sangli District Agro. Farmer Producer Company Limited came to HDFC bank at Pushparaj Chowk, Sangli. They had approached the branch to inquire about the agricultural infrastructural loan for their company. It was informed that the company wanted to set up Bedana processing and packaging unit, therefore they were asked to contact common services center area head Shri. Amol Bageli. Thereafter, bank's employee Manoj Gaikwad and Sushant Madane gave all the information to the accused. They also informed about the documents required for the loan proposal.

Heard learned Advocate for applicants, learned APP for the Respondent-State and learned Advocate for respondent No.2informant. Perused the investigation papers. 4.

Learned APP and learned advocate for the respondent No.2 have strenuously opposed the application by stating that the applicants are co-borrowers and therefore, they actively participated in crime.

Offence is registered on 21st December 2024. Accused No.1 was arrested and has been released on regular bail. It appears from the investigation papers that accused No.1- Mukund Hanmant Jadhavar is main accused though applicants are shown as coborrowers and have signed the loan documents as co-borrowers. It

appears that accused No.1 has responsible for commission of alleged crime.

During investigation, the relevant documents are seized by the Investigating Officer. The applicant No.2 was granted interim protection.

Considering the facts of the present case and the allegations leveled against applicants, their custodial interrogation is not necessary in the facts of the present case. The application is therefore allowed.

In the event of arrest of applicants - Swapnali Mukund Jadhavar, Sakhubai Hanmant Jadhavar, Rajaram Vitthal Kharat, Ajit Vishnu Dalvi and Vijay Shailendra Karad in Crime No. 459 of 2024, registered with Vishrambag Police Station, Sangli, they be released on executing Personal Bond of Rs.15,000/- each with one surety in the like amount.

Till filing of the charge-sheet, the applicants shall attend the concerned police station as and when called by the Investigating Officer.
