The learned Counsel for the applicant submits that the applicant is the second wife of the deceased, Sanjay Singh and the present dispute between the applicant, informant and the other family members pertains to matters of a civil nature. In fact, a civil suit involving the same parties is presently pending adjudication before the competent Civil Court. The contention of the prosecution is that the applicant has submitted forged and fabricated documents before the trial Court. However, no individual, including the informant, has raised any formal grievance or objection before the trial Court with regard to the __________________________________________________ 18 July 2025

The learned Counsel further submits that there is considerable and unexplained delay in the lodging of the FIR, which casts serious doubt on the credibility and genuineness of the FIR. The FIR contains general and vague allegations against the applicant and no specific role is attributed to the applicant. Moreover, the allegations pertains to the documents that are already on record and in the custody of the trial Court in the aforementioned civil proceedings. As such, there is neither any recovery or discovery to be effected from the applicant in the context of the criminal case.

The learned Counsel further seeks leave to implead the first informant as party respondent to this application. Leave granted as prayed for. Necessary amendment shall be carried out within one week from today. After the amendment is carried out, issue notice to the newly added respondent. The applicant to provide a copy of this application to the Registry to enable it to issue notice to the first informant. 3.
The learned APP seeks time to take further instructions. By consent, stand over to 19 August 2025. There shall not be any coercive action against the applicant in the present crime till the next date.
