Heard Mr. Tilak, learned Counsel appearing for the Applicant, Ms. Yadav, learned APP appearing for the RespondentState and Mr. Uttarwar, learned Counsel appearing for the Respondent No.2 i.e. Complainant.

The Applicant by the present Application filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 ("BNSS") is seeking pre-arrest bail in connection with C.R. No. 10 of 2025 registered on 20.01.2025 with Koregaon Park Police Station, Pune City for the offences punishable under Sections 316(2), 316(4),

318(1), 318(2), 318(4), 336(2), 340(2), 238 read with Section 3(5) of the Bharatiya Nyaya Sanhita, 2023 ("BNS"). 3.

It is a contention of the learned Counsel appearing for the Applicant that the Applicant is a Chartered Account and Auditor of Genesis Event Management Company, which is a partnership Firm. He submits that, in fact, the Applicant in his capacity as Auditor has pointed out that there is some irregularities in the account and thereafter, the fraud which has been played by main Accused i.e. Accused No.1 - Yogesh Popat Nawale was discovered. He further submits that the chargsheet is already filed and therefore, the investigation is completed. He submits that the Applicant will abide by conditions imposed by this Court. He further submits that a learned Single Judge has already granted interim protection on 21st July 2025.

On the other hand, Ms. Yadav, learned APP and Mr. Uttarwar, learned Counsel appearing for the Respondent No.2 strongly oppose the Anticipatory Bail Application. Both of them submitted that the Applicant who is the Chatered Accountant has actively helped the main Accused No.1 - Yogesh Nawale. Both of them

further submitted that for a period of about 10 years an amount of about Rs.8,53,00,000/- have been mis-approporiated by Accused No.1- Yogesh Nawale with active help of the present Applicant. Therefore, the Anticipatory Bail be dismissed. 5.

Perusal of the record shows that a learned Single Judge has already granted interim protection to the Applicant by order dated 21st July 2025. The chargsheet is already filed. The Applicant is a Chartered Accountant. Learned Counsel appearing for the Applicant states that the Applicant will be available for the trial. 6.

Accordingly, the case is made out for grant of Anticipatory Bail. In view thereof, the following order is passed:

O R D E R

(a) In the event of arrest of the Applicant - Vikrant Vilas Pansare in connection with C.R. No. 10 of 2025 registered with the Koregaon Park Police Station, Pune the Applicant is directed to be released on bail on his furnishing P.R. Bond in the sum of Rs.1,00,000/- with one or two solvent sureties in the like amount. (b) The Applicant shall attend the concerned Police

Station as and when called.

(c) The Applicant shall furnish his cell phone number and residential address to the Investigating Officer and shall keep the same updated, in case of any change thereto.

(d) The Applicant shall not directly or indirectly make any inducement, threat, or promise to any person acquainted with the facts of the case so as to dissuade such a person from disclosing the facts to the Court or to any Police personnel.

(e) The Applicant shall not tamper with the prosecution evidence and shall not contact or influence the Complainant or any witness in any manner.

(f) The Applicant shall not leave India without prior permission of the Court.
