The learned Counsel for the applicant submits that there is an inordinate and unexplained delay of approximately 10 years in lodging the present FIR, which casts serious doubt on the veracity and genuineness of the allegations. Even if the contents of the FIR are accepted at face value and taken in their entirety to be true, they do not, on a prima facie basis, disclose the commission of any cognizable offence as alleged against the applicant.

The learned Counsel further submits that the applicant is ready and willing to cooperate with the investigation and undertakes to appear before the investigating officer as and when required. In fact, the learned Counsel points out that on 18 June 2025 the applicant was served with the notice under Section 35(3) of the Bharatiya Nagrik Suraksha Sanhita, 2023. Pursuant to the said notice, the applicant appeared before the concerned police station and his statement was also recorded. 3.
The learned Counsel appearing on behalf of respondent No.2 seeks further time to obtain necessary instructions. 4.
By consent, stand over to 21 August 2025. In the meantime, the applicant shall attend the concerned police station on 28th, 29th and 30th July 2025 between 11:00 a.m. and 2:00 p.m., surrender his mobile phone and cooperate with the investigation. There shall not be any coercive action against the applicant in the present crime till the next date. 5.
