This application is filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 seeking pre-arrest bail in connection with C.R. No.347 of 2025 registered with Khed Police Station, Pune Rural, Pune, for the offences punishable under Sections 318(4) and 3(5) of the Bharatiya Nyay Sanhita, 2023.

The prosecution case is set out in paragraph No.5 of the order dated 7th July 2025 passed by the learned Additional Sessions Judge, Khed Rajgurunagar, Pune in Criminal Bail Application No.417 of 2025. The said paragraph No.5 reads as under:
5] It appears that the complainant Ananda Sayaji Jaid lodged report on 12/06/2025. It is alleged that the applicant made phone call to the complainant on 22/04/2025 and informed that she has searched one bride for his son and if he is interested then she is ready to show the bride and the bride has no parents and she is from Omerga and resides with her maternal aunt and wife of her maternal uncle. The applicant also shown photo of bride. The complainant told the applicant to bring the bride at his home. On 23/04/2025 at about 11:00 a.m. the applicant, her husband and bride and her maternal aunt and wife of maternal uncle of bride i.e. coaccused nos. 2 to 4 came at the house of the complainant.
At that time, it was decided to bear the expenses of marriage by the persons of bridegroom, marriage is to be performed by register way and amount of Rs. 1,50,000/- to be paid to the applicant. He paid Rs.20,000/- to the applicant for bringing the bride. After having discussion, the applicant told the complainant why delay is to be made and marriage can be performed on same day. Therefore, marriage was performed at Alandi at New Indrayani Mangal Karyalay. The applicant demanded Rs. 1,50,000/- there. The complainant assured to give amount on next day. However, the applicant did not listen. Therefore, he made payment of Rs.1,10,000/- by online and in cash.
bride. At that time, the applicant and co-accused were present. The cousin brother of bride and their driver went back to Omerga. After that, on 24/04/2025 all the religious programs took place and at about midnight all went to sleep. After that at about 5:30 am when wife of complainant awoke at that time, bride and her maternal aunt did not find there. Therefore, phone call was made to the applicant and she was informed about the incidence. Then applicant came at the house of complainant and she made phone calls to two three persons and made inquiry about the bride and her maternal aunt. However, it was informed that they did not reach at their home. Therefore, the complainant realized that the applicant and coaccused cheated him." 4.
It is the submission of Mr. Desai, learned Counsel appearing for the Applicant that the Applicant after coming to know that the accused No.2 has committed fraud and cheated the First Informant took immediate steps and thereafter as the First Informant started pressurizing her has filed Application dated 29th April 2025 with the Police Superintendent, Pune Rural, Pune. He submits that the Applicant is not involved in the crime. He submits that for last 8 years the Applicant is conducting Marriage Bureau. He submits that the Applicant has cooperated with the investigation and therefore, pre-arrest bail be granted.

On the other hand, Ms. Gajre, learned APP strongly opposes the Anticipatory Bail Application. She submits that although the Applicant has attended the Police Station, however, she has not repaid the amount taken from the First Informant and his son. 6.
However, Mr. Desai, learned Counsel appearing for the Applicant submits that as far as the said amount is concerned, the same has been taken as charges and for the expenses which she has borne for the marriage.

In any case, the accused No.2 against whom the main allegations are made, has been arrested and released on bail. The Applicant attended the Police Station. The Applicant has been protected by order dated 10th November 2025 passed by this Court. 8.
Perusal of the record shows that the custodial interrogation of the Applicant is not necessary.

Accordingly, the case is made out for grant of Anticipatory Bail by imposing certain conditions. In view thereof, the following order is passed:
O R D E R
(a) In the event of arrest of the Applicant-Jyoti Santosh Tamboli in connection with C.R. No.347 of 2025 registered with the Khed Police Station, Pune Rural, Pune, the Applicant is directed to be released on bail on her furnishing P.R. Bond in the sum of Rs.50,000/- with one or two solvent sureties in the like amount. (b) The Applicant shall attend the Khed Police Station, Pune Rural, Pune, as and when called.
(c) The Applicant shall furnish her cell phone number and residential address to the Investigating Officer and shall keep the same updated, in case of any change thereto.
(d) The Applicant shall not directly or indirectly make any inducement, threat, or promise to any person acquainted with the facts of the case so as to dissuade such a person from disclosing the facts to the Court or to any Police personnel.
(e) The Applicant shall not tamper with the prosecution evidence and shall not contact or influence the
Complainant or any witness in any manner.
(f) The Applicant shall not leave India without prior permission of the Court.
