The learned Counsel for the applicant submits that the sole allegation attributed to the present applicant pertains to an alleged incident dated 5 March 2025. It is alleged that on the said date, the applicant, in the company of co-accused Dhobale, approached the informant and purportedly advised her not to disclose name of the main accused, Ganesh, who is alleged to have kidnapped her. Further, it is alleged that the applicant asked the informant that failure to comply would result in a serious case being registered against Ganesh. Chitra Sonawane 2-aba-2073-25.doc assault, are specifically directed towards the co-accused and not the present applicant. It is not alleged that the applicant issued threats to the informant. The applicant is a resident of a nearby village and not from the same vicinity as the informant or the principal accused. Even if the prosecution case is accepted at face value, the charge sheet filed against the co-accused reveals that the only reference to the applicant is a solitary line, devoid of any substantive or corroborative material implicating him in the commission of the alleged offence. The investigation, as it stands, is substantially complete and a final report has already been submitted in respect of the co-accused. Moreover, no recovery or discovery, whether incriminating or otherwise, has been made from or at the instance of the present applicant.

Issue notice to respondent No.2. The investigating officer to serve the notice.

By consent, stand over to 22 August 2025. There shall not be any coercive action against the applicant in the present crime till the next date.
