Heard Mr. Vaish, learned Counsel appearing for the Applicants, Ms. Mrunmayi Kulkarni, learned Counsel for Respondent No.2 and Mr. Mangaonkar, learned APP for the Respondent - State of Maharashtra. 2.

By this Anticipatory Bail Application filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the Applicants are seeking pre-arrest bail in connection with CR No.25 of 2025 registered with the Talegaon Dabhade Police Station, Pimpri-Chinchwad, for the offences punishable under Sections 115(2), 3(5), 351(2), 352 and 85 of the Bharatiya Nyaya Sanhita, 2023.

The First Informant is the wife of the Applicant No.1. It is the contention of the First Informant that, inter alia, on 18th January 2025, Applicant No.1 i.e. Accused No.1 visited the First Informant at her brother's residence in Talegaon. While she was preparing the tea, the husband took away two minor children, aged 5 years and 6 years. 4.

The First Informant i.e. Respondent No.2 and Applicant No.1 i.e. Accused No.1 are personally present in the Court. Mr. Milind Mahadev Nadgeri, Applicant No.1, states that the children will be sent from 22nd October 2025 to 29th October 2025 to the wife during Diwali Vacation and they will stay with the First Informant during that period. Ms. Kanchan Milind Nadgeri, First Informant, states that the children will be sent to the father's place after 29th October 2025. 5.

A writing executed by the Applicant No.1 and the Informant is taken on record and marked "X" for identification. 6.

Both the Applicant No.1 and the First Informant state that efforts will be made to settle the dispute.
