This application is filed under Section 482 of the Bharatiya Nagarik Surakha Sanhita, 2023 ("BNSS") seeking pre-arrest bail in connection with C.R. No.243 of 2025 registered on 06th June 2025 with Pimpri Police Station, District Pimpri Chinchwad, Pune for the offences punishable under Sections 78, 351(2) and Section 351(1) of the Bharatiya Nyaya Sanhita, 2023 ("BNS") and under Section
12 of the Protection of Children from Sexual Offences Act, 2012 ("POCSO").

The prosecution case is set out in Paragraph No.6 of order dated 11th July 2025 passed by Special Judge and Additional Sessions Judge, Pune in Criminal Bail Application No.3960 of 2025. The relevant part of Paragraph No.6 of order dated 11th July 2025 reads as under :- "on perusal of record and statement of victim and other witnesses it appears that, there was love between victim and accused. After some period they stopped to talk with each other. Thereafter again they started to talk with each other. Parents of victim had given understanding to the accused. Thereafter he started to threat the victim. He threatened her that, he will kidnap her brother, he will see her maternal aunt. He had made phone call to her maternal uncle and requested to perform his marriage with victim. He had sent some boys to the house of her maternal uncle and threatened to kill him, therefore, FIR was lodged." 4.
Mr. Vivek Salunke, learned Counsel for the Applicant states that the Applicant has been protected by order dated 31st July 2025. He further states that the chargesheet is also filed.

Mr. Mangonkar, learned APP and Mr. Jugal Kanani, learned Counsel appearing for the Respondent No.2, strongly oppose the Anticipatory Bail.

Perusal of the record shows that a learned Single Judge (CORAM : R.N. LADDHA, J.) by order dated 31st July 2025 has already protected the Applicant and the said protection continues till date.

The chargesheet is already filed and therefore, the interrogation is completed.

Accordingly, the case is made out for grant of Anticipatory Bail. In view thereof, the following order is passed:
O R D E R
(a) In the event of arrest of the Applicant- Girish Raju Bansode in connection with C.R. No.243 of 2025 registered with the Pimpri Police Station, District Pimpri Chinchwad, Pune the Applicant is directed to be released on bail on his furnishing P.R. Bond in the sum of Rs.25,000/- with one or two solvent sureties in
the like amount.
(b) The Applicant shall attend the concerned Police Station on every Sunday between 11:00 a.m. to 01:00 p.m. and in addition, the Applicant shall attend the concerned Police Station as and when called.
(c) The Applicant shall furnish his cell phone number and residential address to the Investigating Officer and shall keep the same updated, in case of any change thereto.
(d) The Applicant shall not directly or indirectly make any inducement, threat, or promise to any person acquainted with the facts of the case so as to dissuade such a person from disclosing the facts to the Court or to any Police personnel.
(e) The Applicant shall not tamper with the prosecution evidence and shall not contact or influence the Complainant or any witness in any manner.
