The learned Counsel for the applicant submits that, apart from the statement made by the co-accused, specifically, the person from whose shop the alleged prohibited items were seized, there is no other material or evidence on record that directly implicates the applicant in the supply or distribution of such banned items within the State of Maharashtra. The learned Counsel further submits that, contrary to the allegations, the prosecution's own case indicates that the said items were procured by the coaccused from the State of Karnataka, where the possession and sale of such items are not proscribed under the relevant Page No. 1 of 2 ____________________________________________ 5 August 2025
Chitra Sonawane 916-aba-2172-2025.doc laws. Hence, there exists a serious doubt regarding the applicant's involvement in any unlawful activity within the jurisdiction of Maharashtra.

The learned APP, however, seeks an accommodation on the ground that the investigating officer is not present. 3.
Stand over to 21 August 2025. There shall not be any coercive action against the applicant in the present crime till the next date.

Liberty to file a copy of the charge sheet filed against the co-accused.
