The Applicant who is Accused No.3 - Sharda D. Daundkar is seeking pre-arrest bail in connection with C.R. No. 229/2025 dated 20th July 2025 registered under Sections 318(4), 336(3), 338, 340(2), 351(2) and 3(5) of Bharatiya Nyaya Sanhita, 2023.

The Accused No.1 - Dilip Vishwanath Gokule is the brother of Complainant - Vijaya Vasant Shelar. It is the prosecution case that said Vijaya Vasant Shelar has share in the ancestral immovable properties. The Accused No.1 - Dilip Gokule mortgaged in the year 2011 property bearing Survey No.376, Kasba Peth, Pune with Pune Urban Co-operative Bank Ltd., Pune and while mortgaging the properties the Applicant i.e. Sharda D. Daundkar impersonated as Vijaya Vasant Shelar to the authorities of Pune Urban Co-operative Bank Ltd., Pune.

Mr. Thatte, learned Counsel for the Respondent No.2 and Mr. Karmarkar, Learned APP for the Respondent-State have strongly opposed granting any protection. It is further submitted that the offence is very serious and therefore, Anticipatory Bail Application be rejected.

The allegation against the present Applicant is very serious. However, it is required to be noted that the said mortgage deed has been executed in the year 2011. The offence, if any, has taken place in the year 2011. The said loan was taken from the Bank in the year 2010-2011. Mr. Purwant, learned Counsel states that the
said loan has been entirely paid and to substantiate the said contention, he relied on Certificate dated 9th May 2025 issued by the Branch Manager, Pune Urban Co-operative Bank Ltd., Pune. The Applicant is housewife of 58 years. The main accused i.e. Accused No.1 i.e. brother of the First Informant and Accused No.2i.e. Sister-in-law of the First Informant have been arrested and their Bail Applications have already been rejected by the learned JMFC.

As far as the present Applicant is concerned there is nothing to indicate that custodial interrogation is necessary. 7.
For the above reasons, the Applicant is entitled to be released on Anticipatory Bail.
O R D E R
(a) In the even of arrest of the Applicant - Sharada Dattatraya Daundkar in connection with C.R. No. 229 of 2025, registered with Dehu Road Police Station, Pimpri Chinchwad, she be released on bail on her furnishing PR Bond in the sum of Rs.25,000/- with one surety in the like amount.
(b) The Applicant shall attend the concerned Police Station, as and when called by the Investigating Officer till the filing of the Charge-sheet and shall cooperate with the investigation.
(c) The Applicant shall furnish her cell phone number and residential address to the Investigating Officer and shall keep the same updated, in case of any change thereto.
(d) The Applicant shall not directly or indirectly make any inducement, threat, or promise to any person acquainted with the facts of the case so as to dissuade such a person from disclosing the facts to the Court or to any Police personnel.
(e) The Applicant shall not tamper with the prosecution evidence and shall not contact or influence the Complainant or any witness in any manner.
