Heard Mr. Nikam, learned Counsel appearing for the Applicants and Ms. Gajre, learned APP for the State. 2.
The Applicant-Rahul Arun Jambhulkar has filed ABA No. 2213 of 2025 and the Applicant-Prabhakar @ Pralhad Vitthal Jambhulkar has filed ABA No. 2221 of 2025, under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 ("BNSS"), seeking
pre-arrest bail in connection with C.R. No.285 of 2025 registered with Hinjwadi Police Station, Pimpri-Chinchwad, for the offences punishable under Sections 118 (1), 118(2), 324(4), 189(2), 189(4), 190, 131, 351(2), of the Bharatiya Nyaya Sanhita, 2023 ("BNS") and Section 3 and 25 of the Indian Arms Act, 1959. 3.
It is the main submission of Mr. Nikam, learned Counsel for the Applicants that in fact the Applicant- Rahul Jambhulkar has filed the Complaint dated 10th May 2025 with Hinjwadi Police Station, Pimpri-Chinchwad regarding encroachment by Jalindar Jambhulkar and others. He submits that in fact said Jalindar Jambhulkar along with 5 other persons filed Regular Civil Suit No. 2017 of 2024 seeking injunction against Rahul Jambhulkar and Vishwanath Vitthal Jambhulkar. He submits that Exhibit-5 Application seeking injunction filed in said Suit has been rejected by the learned 7th Civil Judge, Senior Division, Pune, by Order dated 3rd May 2025. He submits that in fact there is a cross F.I.R. regarding the same incident i.e. C.R. No. 286 of 2025 registered on 8th June 2025 with Hinjwadi Police Station, Pimpri-Chinchwad under Sections 115(2), 118 (1), 189(4) 351(2), 352, 189(1), 189(2) of the Bharatiya Nyaya Sanhita, 2023 ("BNS"), Section 4
and 25 of the Indian Arms Act, 1959 and Sections 37(1), 37(3), and 135 of Maharashtra Police Act, 1951. He submits that the Applicants have no antecedents and the Applicants will co-operate with the investigation. He, therefore submits that the Anticipatory Bail Applications be granted.

On the other hand, Ms. Gajre, learned APP strongly opposes the Application. She submits that there may be civil dispute between the parties, however, the manner in which the offence is committed is very serious, in which 40 persons with weapons have assaulted the injured. She points out Injury Certificate showing that one injured namely Ketan Molak has suffered fracture. She submits that other injured Prathmesh Ashok Waghmare has also received serious injuries.

Perusal of record shows that the Applicant- Rahul Jambhulkar has already filed Complaint with Hinjwadi Police Station, Pimpri-Chinchwad on 10th May 2025 being C.R. No. 253 of 2025 lodged with Hinjwadi Police Station, Pimpri-Chinchwad under Sections 329(3), 352, 351(2), 189(2) and 191(2) of
Bharatiya Nyaya Sanhita, 2023 ("BNS") against Jalinder Jambhulkar and 7 others.

Perusal of record further shows that in fact said Jalinder Jambhulkar and 5 other persons have filed Regular Civil Suit No. 2071 of 2024 concerning the properties in question and by Order dated 3rd May 2025 passed by learned 7th Joint Civil Judge, Senior Division, Pune below Exhibit-5 in Regular Civil Suit No. 2071 of 2024, the said Application has been rejected. 7.
Perusal of record further shows that as far as the incident in question, there is cross F.I.R. being C.R. No. 286 of 2025 registered with Hinjwadi Police Station, Pimpri-Chinchwad. 8.
The Applicants have no antecedents.

Mr. Nikam, learned Counsel for the Applicants submits that the Applicants will co-operate with the investigation. 10.
Accordingly, the case is made out for granting anticipatory bail to the Applicants. Hence, following Order is passed:
O R D E R
(i) In the event of arrest, the Applicants - 1) Rahul Arun Jambhulkar and 2) Prabhakar @ Pralhad Vitthal Jambhulkar be released on bail in C.R. No.285 of 2025 registered with Hinjwadi Police Station, PimpriChinchwad, on executing P.R. bonds of Rs.50,000/- each and furnishing one or two solvent sureties each in the like amount.
(ii) The Applicants shall attend the concerned Police Station once in a week i.e. on every Sunday between 11.00 a.m. to 2.00 p.m. and shall co-operate with the investigation.
(iii) The Applicants shall furnish their cell phone numbers and residential address to the Investigating Officer and shall keep the same updated, in case of any change thereto.
(iv) The Applicants shall not directly or indirectly make any inducement, threat, or promise to any person
acquainted with the facts of the case so as to dissuade such a person from disclosing the facts to the Court or to any Police personnel.
(v) The Applicants shall not tamper with the prosecution evidence and shall not contact or influence the Complainant, or any witness, in any manner.
(vi) The Applicants shall not leave India without prior permission of the Court.

The Anticipatory Bail Applications are allowed and disposed of accordingly.
