By this application, the applicant seeks pre-arrest bail in connection with CR No.35 of 2025, registered at Bazarpeth Police Station, Thane City, for the offences punishable under Sections 406, 420 read with 34 of the Indian Penal Code, 1860 ('IPC') and Sections 3 and 4 of the Maharashtra Protection of Interest of Depositors (In Financial Establishments) Act, 1999 ('MPID Act').

At the outset, the learned APP, following the instructions from the Investigating Officer present in the Court, submits that although the FIR contains allegations to the effect that the co-accused had conveyed to the complainant that their funds had been invested in the applicant's company, namely 'Lotus India', the investigation conducted thereafter has not substantiated such a claim. Specifically, it has emerged during the course of investigation that no investment has, in fact, been made by the complainant or informant in the applicant's said company. The learned APP candidly submits that the investigation in the present case stands concluded, and further, that the prosecuting agency does not seek the custodial interrogation or arrest of the applicant.

In view of the aforesaid submissions and considering the fact that no custodial interrogation is required, the application

stands allowed on the following terms :

(i) In the event of the applicant's arrest in connection with CR No.35 of 2025, registered at Bazarpeth Police Station, Thane City, for the offences punishable under Sections 406, 420 read with 34 of the IPC and Sections 3 and 4 of the MPID Act, he shall be released on bail upon executing a PR Bond of Rs.25,000/- and furnishing one or more sureties in the like amount.

(ii) The applicant shall attend the concerned police station as and when required by the Investigating Officer.

(iii) The applicant, himself, or through any other person, shall not tamper with the prosecution's evidence and influence the witnesses.
