DATE : 20th April, 2026.
P. C. :
1.
Heard the learned counsel appearing on behalf of the Applicant and the learned APP for the Respondent-State. I have gone through the case diary.
2.
The Applicant seeks anticipatory bail in connection with Crime No. 0454 of 2025, registered with Akluj Police Station (Solapur Rural) for the offences punishable under Sections 64, 351(2), 351(3), and 356(2) of the Bharatiya Nyaya Sanhita, 2023.
3.
It appears from the complaint that the victim alleged that the Applicant, with whom she was acquainted, took her to a lodge on 02.10.2024 and established physical relations by force. Subsequently, on 04.05.2025, he allegedly again took her by threatening to expose their relationship to others. During this time, a forced marriage was purportedly solemnized. The victim further alleged that she was taken to a lodge on two or three subsequent occasions where sexual intercourse occurred. After the victim disclosed these incidents to her uncle, the complaint was lodged, and the aforementioned offences were registered against the Applicant. 4.
Prima facie, it appears that the victim is a major who became acquainted with the Applicant via Instagram. She accompanied the Applicant to the lodge where the alleged sexual intercourse first took place on 02.10.2024. It further appears that the act was repeated on three subsequent occasions. Considering these facts, the possibility of consensual sexual intercourse cannot be ruled out at this stage. 5.
Learned APP has informed the Court that the investigation is complete and the charge-sheet has been filed. It is also to be noted that the Applicant was previously protected by an ad-interim order. The Applicant has appeared before the concerned police station and cooperated in the investigations. 6.
In view of the above and considering the facts of the case, a case is made out for the confirmation of the ad-interim order dated 08.09.2025.
7.
The Application is allowed. Interim order dated 08.09.2025 stands confirmed.
8.
With this, the Application stands disposed of. [ M.W. CHANDWANI, J. ] Digitally signed by TALLE SHUBHAM ASHOKRAO Date:
