This is an application for Anticipatory Bail. 3.
The applicant is apprehending his arrest in Crime No. 119 of 2025 registered at Bhayander Police Station, for the offences punishable under Sections 318(4), 316(2), 316(5), 61(2) and 3(5) of the Bharatiya Nyaya Sanhita, 2023 (BNS), Sections 3 & 4 of the Maharashtra Protection of Interest of Depositors (In Financial Establishments) Act, 1999 (MPID Act) and Sections 3, 4 1/7
and 13 of the Maharashtra Ownership Flats (Regulation of the Promotion of Construction Sale, Management and Transfer) Act, 1963 (MOFA Act).

The allegations against the applicant and other coaccused are inter-alia of cheating. 5.
The learned counsel for the applicant and the learned counsel for the first informant jointly submit that the parties have amicably settled their dispute and tendered the consent terms to that effect, which are taken on record and marked as "X" for the purpose of identification. The first informant has also filed affidavit, the same is taken on record and marked as "X1" for the purpose of identification. For ease of reference, the consent terms are scanned and reproduced herein below :

Considering the fact that the parties have settled their dispute, I am inclined to release the applicant on anticipatory bail. In the result, the following order is passed :
O R D E R
a) The Application is allowed.
b) In the event of arrest of the applicant in connection with Crime No. 119 of 2025 registered at Bhayander Police Station, for the offences punishable under Sections 318(4), 316(2), 316(5), 61(2) and 3(5) of the Bharatiya Nyaya Sanhita, 2023 (BNS), Sections 3 & 4 of the Maharashtra Protection of Interest of Depositors (In Financial Establishments) Act, 1999 (MPID Act) and Sections 3, 4 and 13 of the Maharashtra Ownership Flats (Regulation of the Promotion of Construction Sale, Management and Transfer) Act, 1963 (MOFA Act), the applicant be released on bail on furnishing P.R. Bond in the sum of Rs. 25,000/- with one or two sureties in the like amount.

c) The statements made in the consent terms are accepted as undertaking to this Court.
d) In case of breach of consent terms, liberty is granted to the first informant to file an application for cancellation of anticipatory bail granted by this order.

The application is disposed of in the aforesaid terms.
