This is an Application filed under Section 482 of The Bharatiya Nagarik Suraksha Sanhita, 2023 ("B.N.S.S.") seeking pre-arrest bail in connection with C.R. No.303 of 2025, registered with Indapur Police Station, Pune Rural, for the offences punishable under Sections 118(1), 324(4), 115(2), 119(1), 333, 189(2), 190, 191(2) of Bhartiya Nyaya Sanhita, 2023 and under Sections 4 and 25 of the Arms Act, 1959.

As per the prosecution case, on 26th April 2025, at around 8.00 p.m., the Applicant and co-Accused came towards the house of the Informant by two-wheelers and by entering into his house, started to make enquiry about the Informant's son- Charan. Suddenly, Applicant Sunil assaulted him by fist blows and kicks and Applicant Pradip armed with a sword, damaged the Informant's car. All Accused abused and threatened to kill and left the spot.

Mr. Mangaonkar, learned APP strongly opposes granting pre-arrest bail to the Applicants.

Perusal of the record shows that the injuries are simple. As far as allegations regarding use of sword is concerned, the same has been used for damaging the car, and the assault on the first informant was by stick, fist blows and kicks. 6.
Admittedly, the Applicants have no antecedents. The injures are simple. There is a cross- F.I.R. bearing CR No.302 of 2025 registered with Indapur Police Station, Pune Rural against the son of the informant and 10 other persons.

Accordingly, the Applicants are entitled to pre-arrest bail. Hence, following Order is passed:
O R D E R
(i) In the event of arrest in C.R. No.303 of 2025, registered with Indapur Police Station, Pune under Sections 118(1), 324(4), 115(2), 119(1), 333, 189(2), 190, 191(2) of Bhartiya Nyaya Sanhita of 2023 and under Sections 4 and 25 of Arms Act, 1959, the Applicants - Sunil Popat Gurgude, Pradip Sarang Gurgude, Altaf Jabbar Shaikh and Dhanaji Baban Kharade be released on bail on executing P.R. bond of Rs.25,000/- each and each furnishing one or two sureties in the like amount.
(ii) The Applicants shall attend the concerned Police Station once in a week i.e. on Sunday between 11.00 a.m. to 3.00 p.m.
(iii) The Applicants shall furnish their cell phone numbers and residential address to the Investigating Officer and
shall keep the same updated, in case of any change thereto.
(iv) The Applicants shall not directly or indirectly make any inducement, threat, or promise to any person acquainted with the facts of the case so as to dissuade such a person from disclosing the facts to the Court or to any Police personnel.
(v) The Applicants shall not tamper with the prosecution evidence and shall not contact or influence the Complainant, or any witness, in any manner.

The Anticipatory Bail Application is allowed and disposed of accordingly.
