The applicant is seeking anticipatory bail in the context of FIR No. 0260 of 2024 dated 14th September 2024 registered at Bundgarden Police Station, Pune, for offence under Sections 420, 406 and 409 read with 34 of the Indian Penal Code, 1860 (IPC). Further offences have been added in the present case pursuant to investigation.

Record shows that the applicant has repeatedly approached the Sessions Court and this Court, seeking anticipatory bail. On some occasions, the applications have been dismissed on merits and on other occasions, they have been withdrawn by the applicant.

It is to be noted that, in one such application bearing Anticipatory Bail Application No.1915 of 2025 filed by the applicant, during the period when her anticipatory bail application on merits was pending before the Sessions Court, by an order dated 13th August 2025, this Court (Coram: R. N. Laddha, J.) had directed that the pending anticipatory bail application before the Sessions Court be decided within 10 days and till that time, coercive action was not be taken against the applicant. 5.
Subsequently, on 21st August 2025, the Sessions Court rejected the anticipatory bail application of the applicant and in these circumstances, the applicant has approached this Court. 6.
The learned counsel appearing for the applicant submits that charge-sheet has now been filed in March 2025. It is submitted that the applicant had returned the alleged ill-gotten amount received in her account in the context of a scam that was discovered in the Sassoon Hospital at Pune, where the applicant was working as a nurse. It is submitted that since the entire alleged amount illegally finding its way to the account of the applicant was returned, as also the fact that the applicant all through has been ready to cooperate with the investigation, this Court may consider granting relief in the present anticipatory bail application. 7.
It is further submitted that this Court has granted anticipatory bail to co-accused persons against whom the similar allegations have been made and that some of the accused have
been granted regular bail.

The learned APP is opposing the prayer made in the present application, inter alia, on the ground that the applicant has not cooperated with the investigation and she is repeatedly knocking the doors of Sessions Court and this Court, to seek anticipatory bail. She has not been granted such relief till date and there is no reason why this Court should show any indulgence to such an accused person.

This Court finds that three co-accused persons have been recently granted anticipatory bail by orders dated 23rd September 2025 passed by this Court (Coram: Madhav Jamdar, J.) in Anticipatory Bail Application Nos. 965 of 2025, 1818 of 2025 and 662 of 2025. Four other accused persons have been granted regular bail by the Sessions Court.

The applicant is a woman and the relevant portion of charge-sheet shows that the amount that found its way into her account was returned in about three months' time. It appears that since four co-accused persons, against whom the similar allegations have been made, have been granted anticipatory bail by this Court, so long as the applicant undertakes to appear before the investigating agency for cooperating with the investigation, while keeping this application pending, interim relief can be granted.

In view of the above, the instant application shall be listed for further consideration on 6th November 2025. 12.
In the meanwhile, there shall be interim relief in the following terms :
(a) Till the next date, in the event the applicant is arrested in connection with FIR No.0260 of 2024 dated 14th September 2024 registered at Bundgarden Police Station, Pune, she shall be released on bail on furnishing PR Bond of Rs.50,000/- and one or two sureties in the like amount. (b) The applicant shall remain present before the Office of Economic Offence Wing, Pune, on 9th and 11th October 2025 between 10:00 a.m. and 12:00 noon and thereafter, as and when called by the concerned Officer. The applicant shall co-operate with the investigation.
(c) The applicant shall not tamper with the evidence of the prosecution in any manner. She shall not influence the informant, witnesses and other persons concerned with the case.

In the event, the applicant violates any of the aforesaid conditions, the order passed today would be recalled. MANISH PITALE, J.
