This is an Application for Anticipatory Bail. 2.

The Applicant apprehends his arrest in C. R. No. 200 of 2025 registered with the Narpoli Police Station, Thane City for the offences punishable under Sections 118(1), 118(2) & 352 of the Bhartiya Nyaya Sanhita, 2023 ("BNS").

According to the prosecution, on 03.02.2025, the present Applicant and other Co-accused assaulted the First Informant by some sharp weapon and caused him grievous injuries. 4.

I have heard learned Counsel for the Applicant and the learned APP for the Respondent - State.

Learned Counsel for the Applicant submits that the Applicant Anand

17. ABA 2375-2025.doc was not present at the time of alleged incident. It is submitted that there is no need of custodial interrogation as, nothing is to be recovered at the instance of the present Applicant. He further submits that there are no other Criminal antecedents. 6.

On the other hand, learned APP for the Respondent - State submits that the First Informant was assaulted for no reason. It is submitted that considering the nature of crime, the Applicant may not be released on Anticipatory Bail.

The prosecution has already filed a Charge-sheet against the present Applicant. There is no need of custodial interrogation of the present Applicant, as nothing is to be recovered from him. Considering the said facts, I am inclined to release the Applicant on Anticipatory Bail on the following terms and conditions.

O R D E R (i) In the event of arrest, the Applicant be released on bail on his furnishing P. R. Bond in the sum of Rs. 25,000/- with one or two solvent sureties in the like amount.
