This is an application for Anticipatory Bail. 2.
The applicant is apprehending his arrest in Crime No. 249 of 2025 registered at Central Police Station District- Thane for the offences punishable under Sections 3(5), 118(2), 115(2) & 109 of Bharatiya Nyaya Sanhita, 2023.

It is the case of the prosecution that on the date of incident which took place on 02.04.2025, due to
certain financial dispute the applicant and other coaccused had assaulted the first informant and his colleagues by stick etc. and attempted to commit their murder.

The learned counsel for the applicant has drawn my attention to the order dated 25.06.2025 passed by the Additional Sessions Judge, Kalyan in Anticipatory Bail Application No. 1132 of 2025, by which the learned Additional Sessions Judge has granted Anticipatory Bail to the co-accused Sufiyan Kasam Shaikh. The learned counsel for the applicant submits that the role attributed to the said co-accused Sufiyan Kasam Shaikh and the present applicant is similar. It is further submitted that the prosecution has already filed charge-sheet against the arrested co-accused.

On the other hand, the learned APP for the respondent-State submits that the applicant is involved in serious offence of attempt to murder. It is submitted that, considering the nature of crime, the applicant may not be released on anticipatory bail.

I have perused the charge-sheet. The role attributed to the co-accused Sufiyan Kasam Shaikh and the present applicant appears to be similar. There are no other criminal antecedents. In that view of the matter, I am inclined to release the applicant on anticipatory bail. In the result, the following order is passed.
ORDER
a] The Application is allowed.
b] In the event of arrest of the applicant in connection with Crime No. 249 of 2025 registered at Central Police Station District- Thane for the offences punishable under Sections 3(5), 118(2), 115(2) & 109 of Bharatiya Nyaya Sanhita, 2023. The applicant be released on bail on furnishing P. R. Bond in the sum of Rs.25,000/- with one or two sureties in the like amount;
c] The applicant shall not commit any other crime. d] The applicant shall attend the concerned police station as and when called by the investigating officer for the purpose of supplementary chargesheet. e] The applicant shall attend the concerned police station once in a month i.e. on first Saturday between 11.00 a.m to 2.00 p.m till conclusion of
the trial.
f] Liberty is granted to the prosecution to file an application for cancellation of bail if the applicant commits breach of any of the above condition. (N. R. BORKAR, J.)
