Prosecutrix has lodged F.I.R. against the applicant, alleging forcible physical relations, blackmailing and extortion. 3.

Heard learned counsel for the applicant, learned APP for the State and learned advocate for the respondent-prosecutrix. Perused the record.

Though it is alleged in the F.I.R. that the applicant forcibly established physical relations with the prosecutrix and blackmailed her, the documents placed on record by the applicant in the form of exchange of WhatsApp messages between the applicant and prosecutrix prima facie show that the relations between them were consensual.

The applicant is a police officer and serving at Solapur. Learned advocate for the prosecutrix contends that the applicant stays in the same colony and being police officer, the applicant will influence the investigation.

The applicant has co-operated in the investigation and has surrendered his cellphone. No custodial interrogation and/or detention of the applicant is warranted in the peculiar facts of the present case. In the result, the application is allowed by confirming the interim order dated 15th October 2025.

The applicant shall cooperate in the investigation and attend the police station as and when called by the Investigating Officer.
