Learned APP for the Respondent-State, on instructions, submits that the prosecution is proposing to file 'B' Summary in the crime in question and papers of investigation are submitted to the concerned Deputy Commissioner of Police for approval.

In that view of the matter, Learned Counsel for the Applicant at this stage seeks leave to withdraw the present Application with liberty to file a fresh application, if 'B' Summary is not filed or it is not accepted by the concerned Court.

The present Anticipatory Bail Application is disposed of as withdrawn with liberty as prayed for.

4.

If 'B' Summary is not filed or not accepted by the Court, in that event, the investigating officer shall inform about it to the Applicant and the Applicant shall not be arrested for a period of seven days from the date of such intimation.
