The relief sought in the present Application filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 is pre-arrest bail in connection with CR No.132 of 2025 registered with the Supa Police Station, Baramati, District-Pune for the offence punishable under Sections 316(5) and 318(4) of the Bharatiya Nyaya Sanhita, 2023.

As per the prosecution case, the Applicant is engaged in a business of purchase and sale of the agricultural products and he has accepted Rs.23,20,000/- from the First Informant, however, not supplied the agricultural products and not even returned the amount.

Mr. Deshpande, learned Counsel for the Applicant on 8th September 2025 submitted that although the FIR is concerning a civil dispute and the same is converted into the criminal case, however, the Applicant is intending to return back the entire amount of Rs.23,20,000/-. He further states that accordingly the said amount has been deposited in the account of the First Informant.

Prima facie, there is substance in the contention of learned Counsel for the Applicant that the dispute essentially is of civil nature. Mr. Deshpande, learned Counsel, states that however the Applicant will completely cooperate with the investigation. 5.

Accordingly, the case is made out for grant of anticipatory bail. In view thereof, the following Order is passed:

O R D E R

(a) In the event of arrest of the Applicant - Vishwajeet Ashokrao Raghatate in connection with CR No.132 of 2025 registered with the Supa Police Station, Baramati, District-Pune, the Applicant is directed to be released on bail on his furnishing PR Bond in the sum

of Rs.25,000/- with one or two solvent sureties in the like amount.

(b) The Applicant shall attend the concerned Police Station as and when called by the Investigating Officer and shall cooperate with the investigation.

(c) The Applicant shall furnish his cell phone number and residential address to the Investigating Officer and shall keep the same updated, in case of any change thereto.

(d) The Applicant shall not directly or indirectly make any inducement, threat, or promise to any person acquainted with the facts of the case so as to dissuade such a person from disclosing the facts to the Court or to any Police personnel.

(e) The Applicant shall not tamper with the prosecution evidence and shall not contact or influence the Complainant or any witness in any manner.

(f) The Applicant shall not leave India without prior permission of the Court.

The Anticipatory Bail Application is disposed of accordingly. [MADHAV J. JAMDAR, J.]
