This is an Application for Anticipatory Bail. 2.

The Applicant apprehends his arrest in connection with C. R. No. 429 of 2025 registered with the Kherwadi Police Station, Bandra(E), Mumbai for the offences punishable under Sections 118(2), 118(1), 115(2), 352, 351(3) and 3(5) of the Bhartiya Nyaya Sanhita, 2023 ("BNS").

According to the prosecution, on the date of the incident which took place on 04.08.2025, the present Applicant and other Co-accused assaulted the First Informant and his friends by a knife and iron fighter on account of some previous dispute due to which they sustained

grievous injuries.

I have heard learned Counsel for the Applicant and the learned APP for the Respondent - State.

Learned Counsel for the Applicant submits that the Applicant has nothing to do with with the alleged crime. It is submitted that nothing is to be recovered at the instance of the present Applicant and therefore, there is no need of custodial interrogation. Learned Counsel for the Applicant further submits that there are no other Criminal antecedents.

On the other hand, learned APP submits that the present Applicant and other Co-accused assaulted the First Informant and his friends by a knife and fighter. It is submitted that considering the nature of crime, the Applicant may not be released on Anticipatory Bail.

I have perused the FIR. It appears that at the time of the alleged incident, the Applicant was not armed with any weapon. According to the First Informant, the present Applicant assaulted him by fist & kick blows. The injuries are simple in nature. There is no need of custodial interrogation as nothing is to be recovered at the instance of the Applicant.

Considering the overall facts and circumstances, I am inclined to release the Applicant on Anticipatory Bail on the following terms and conditions.

O R D E R (i) In the event of arrest, the Applicant be released on bail on his furnishing P. R. Bond in the sum of Rs. 25,000/- with one or two solvent sureties in the like amount;

(ii) The Applicant shall attend the concerned police station from 17th to 19th September, 2025 between 11.00 a. m. and 1.00 p. m.. and shall co-operate in the investigation.
