Mr. Bhushan Raut i/b Hemant Kamble, for the Applicants. Mr. A. R. Metkari, APP, for the Respondent-State. Mr. Prasad Borkar a/w Manoj Borkar & Tanmay Mishra, for the Original Informant.
P.S.I. Hanmant Pawar, Bavdhan Police Station, Pimpri Chinchwad, District - Pune, present.
CORAM:
MADHAV J. JAMDAR, J.
DATED:
11 SEPTEMBER 2025 PC:- 1.
Heard Mr. Bhushan Raut, learned Counsel appearing for the Applicants, Mr. Prasad Borkar, learned Counsel appearing for the Original Informant i.e. father of the deceased and Mr. Metkari, learned APP for the Respondent-State of Maharashtra. 2.
The relief sought in this Anticipatory Bail Application is prearrest bail in connection with CR No.252 of 2025 registered with the Bavdhan Police Station, Pimpri Chinchwad, District-Pune for
the offence punishable under Sections 108, 351(2) and 3(5) of the Bharatiya Nyaya Sanhita, 2023.
3.
It is the prosecution case that Accused No.1 is the wife of the deceased who died by suicide. Accused Nos.2 and 3 are the parents of the Accused No.1 and Accused No.4 is the brother of the Accused No.1. The Accused Nos.2, 3 and 4 are the present Applicants. As far as Accused No.1 is concerned, she has been arrested on 7th July 2025 and by the Order dated 13th August 2025 passed by the learned Additional Sessions Judge, Pune in Bail Application No.5179 of 2025 she has been released on bail. 4.
As per the prosecution case, the deceased who is as noted herein above the husband of the Accused No.1, son-in-law of Accused Nos.2 and 3, and brother-in-law of Accused No.4, died by suicide between 16th June 2025 and 19th June 2025. As per the prosecution case, the deceased had filed a Divorce Petition in the Family Court, Saket, New Delhi and the Accused were bringing pressure on the deceased for payment of Rs.40,00,000/- and return of some ornaments as the condition for getting divorce and due to said pressure the deceased had committed suicide.
5.
Mr. Metkari, learned APP for the Respondent-State of Maharashtra and Mr. Borkar, learned Counsel for the First Informant strongly opposes the grant of anticipatory bail. Both of them submit that as the Accused were bringing pressure on the deceased to pay Rs.40,00,000/- as a condition for getting divorce, the deceased died by suicide. Both of them submit that there is material on record showing the involvement of the Applicants in the crime and therefore the Anticipatory Bail Application be rejected.
6.
Perusal of the record shows that the main allegations are against the Accused No.1 who has already been arrested and who is granted regular bail. In any case, the custodial interrogation is not necessary. There are no criminal antecedents against the Applicants.
7.
Accordingly, the case is made out for grant of anticipatory bail. In view thereof, the following Order is passed:
O R D E R
(a) In the event of arrest of the Applicant No.1 - Satish Trilokchand Jindal, Applicant No.2 - Poonam Jindal
