DATE : 10 NOVEMBER, 2025 P.C. :- 1) On 16 October, 2025 the following order was passed :- 1) It has been submitted before me that apart from the present applicant, two more persons have been added as accused who are the employees of the Thane Municipal Corporation. The notices have been issued to the newly added two employees of the Municipal Corporation by the Investigating Officer.
2) It is also submitted that as per the allegations of the police, pursuant to the forged document, an amount of Rs.5,10,000/- from the Corporation have been collected in the account of the contractor M/s.Janhvi Construction Company. Thereafter, there is cheque issued by M/s.Janhvi Construction Company for a sum of Rs.3,35,000/- in the name of the present applicant. The issuance of cheque of M/s.Janhvi Construction Company to the present applicant is not disputed.
3) The allegation of the prosecution is that the present applicant in connivance with the officers of the Corporation, has prepared forged documents pursuant to which, amount from the Corporation has been credited in the account of the contractor M/s.Janhvi Construction Company.
4) It has been further submitted before me that the applicant has visited the concerned Investigating Officer on 12 August 2025, 13 August 2025 and 14 August 2025 pursuant to the directions given by this Court on 7 August, 2024.
5) prima facie I am of the view that the present applicant

However, in case, the Investigating Officer wants to record further statement of the present applicant for the investigation purpose, the present applicant is directed to attend the office of the Investigating Officer on 27 October 2025 and 28 October 2025 between 11:00 a.m. to 1:00 p.m. 6) In the meantime, no coercive steps be taken against the present applicant till the next date of the hearing. 7) Stand over to 10 November, 2025.
2) The learned A.P.P. on instructions from the Police Officer from Naupada Police Station submits that the applicant has cooperated in the investigation and has attended the office of the Investigating Officer on 27 October, 2025 and 28 October, 2025. He further submits that the charge-sheet is likely to be filed within a period of 15 days and hence the custody of the applicant is not necessary. Statement accepted.
3) In view of the statement made by the learned A.P.P. on instructions from the Officer of Naupada Police Station, the present Anticipatory Bail Application stands disposed off. [RAJESH S. PATIL, J.]
