This is an application for anticipatory bail. 2.

The applicant is apprehending his arrest in Crime No. 981 of 2024 registered at Samtanagar Police Station for the offences punishable under Sections 115(2), 118(2), 126(2), 309(4), 324(2) and 61(2) read with Section 3(5) of the Bharatiya Nyaya Sanhita, 2023.

According to the first informant, on the date of incident, which took place on 16th December 2024, three unknown persons assaulted him by iron rod due to which he sustained fracture injury to his right leg. According to the prosecution, the first informant was assaulted due to certain business related issues and the present applicant was one of the assailant. 1/3

I have heard the learned counsel appearing for the applicant and the learned APP for the respondent / State. 5.

Learned counsel for the applicant submits that the applicant has nothing to do with the alleged crime. It is submitted that the motive for alleged crime is attributed to the co-accused. It is submitted that there are no other criminal antecedents. 6.

On the other hand, learned APP for the respondent/State submits custody of the applicant is required to conduct the Test Identification Parade. It is submitted that the applicant has received Rs.500/- from the co-accused to assault the first informant.

According to the prosecution, the present applicant and other two assailants were hired to assault the first informant. The prosecution has filed the charge-sheet against the co-accused and there is no convincing material to that effect. Considering the overall facts and circumstances and as there are no other criminal antecedents against the applicant, I am inclined to release the applicant on anticipatory bail. In the result the following order is passed.

ORDER

A) The Application is allowed.

B) In the event of arrest of the applicant in C.R. No. 981 of 2024 registered at Samta Nagar Police Station for the 2/3

offences punishable under Sections 115(2), 118(2), 126(2), 309(4), 324(2) and 61(2) read with Section 3(5) of the Bharatiya Nyaya Sanhita, 2023, he be released on bail on executing P.R. Bond in the sum of Rs.25,000/- with one surety or two sureties in the like amount.

C) The applicant shall attend the concerned police station from 22nd September 2025 to 24th September 2025 in between 11.00 a.m. and 2.00 p.m. and shall cooperate in the investigation.
