The Applicants apprehend arrest in Crime No.0832 of 2025 registered with Barshi City Police Station, Solapur Rural, for the offences punishable under Sections 406, 420, 465, 468, 471 read with Section 34 of the Indian Penal Code, 1860 (for short, "IPC"). 2.
According to the prosecution, all the accused, in connivance with each other, prepared forged documents and thereby cheated the complainant to the tune of Rs.2,10,00,000/-.

Heard learned Advocate for the Applicant, learned APP for the Respondent - State and learned Advocate for the intervenor. Perused the record.

It is a matter of record that pursuant to the registration of offence under the Maharashtra Protection of Interest of Depositors (in Financial Establishments) Act, 1999 (for short, "MPID Act") against the Applicant in the year 2017, all the relevant documents as well as properties of the Applicants were seized in the year 2017. According to the Applicants, they are not signatories to the alleged mortgaged deed. The documents seized from the Applicants and other accused form part of the record of the MPID Court.

The informant had made an application in the year 2022 seeking release of the properties attached by the Investigating Agency. A relative of the informant has also filed an application to the MPID Court in the year 2024 seeking similar relief. 6.
Learned APP as well as learned Advocate for the Intervenor strenuously submitted that the Applicants are the beneficiaries and an amount of Rs.10,00,000/- is deposited in the account of the Applicant No.1 and amount of Rs.2,00,000/- is deposited to the account of Applicant No.2. Therefore, their custody is required for the investigation.

Fact remains that husband of the Applicant No.1 who was Chairman and Managing Director of the Company has expired in the year 2020.

For the present nothing is with the Applicants and entire documents are part of the record of the MPID case. Considering that nothing is to be recovered from the Applicants and Applicants being ladies, they are entitled for protection.

In the result, the application is allowed.

In the event of arrest, the Applicants - Vanita Devidas Sajnani and Deepa Devidas Sajnani in connection with C.R. No.0832 of 2025 registered with Barshi City Police Station, Solapur Rural, for the offences punishable under Sections 406, 420, 465, 468, 471 read with Section 34 of the Indian Penal Code, 1860 (for short, "IPC"), they be released on executing Personal Bond of Rs.15,000/- each with one surety in the like amount.

The Applicants shall not tamper the prosecution evidence. 12.
The Applicants shall attend the concerned police station as and when called by the Investigating Officer. (NITIN B. SURYAWANSHI, J.)
