Applicants apprehend arrest in Crime No.735 of 2025 registered with Sadar Bazar Police Station, District: Solapur, for the offence punishable under Sections 318(4), 336(3), 337, 338, 340(2), 341(2) of the Bharatiya Nyaya Sanhita, 2023 (for short, "BNS Act").

The prosecution case is that the Applicants borrowed a loan of Rs.10,00,000/- from the Fed Bank Financial Services, Pune in August 2023, by hypothecating the Grampanchayat property No.1203, situated at Yelmar Mangewadi, Tal. Sangola, District: Solapur. The Applicants did not repay the loan. On scrutiny of the revenue documents submitted by the Applicants, it was revealed that they are bogus. Hence, the FIR is lodged.

After arguing at length on merits when this Court was not inclined to grant relief, learned advocate for the Applicants, on instructions, seeks permission to withdraw the application of Saipan Abdul Sattar Mujavar and Santosh Atmaram Chougule. 4.
Permission is granted.

The application of Saipan Abdul Sattar Mujavar and Santosh Atmaram Chougule is dismissed as withdrawn.

On perusal of the investigation papers, it appears that no active role is played by Applicant - Nilophar Saipan Mujavar. She appears to have acted at the instance of her husband Applicant - Saipan Abdul Sattar Mujavar. Her custodial interrogation therefore is not necessary, in these peculiar facts. She being a lady deserves protection.

So far as Applicant No.2 Ashwini Santosh Chougule is concerned, she was granted interim protection and she has co-
operated in the investigation. Being a lady, her custodial interrogation is not warranted in the facts of the present case, therefore, her application deserves to be allowed.

The applications of Nilophar Saipan Mujavar and Ashwini Santosh Chougule are allowed.

In the event of arrest of Applicants - Nilophar Saipan Mujavar and Ashwini Santosh Chougule in connection with Crime No.735 of 2025 registered with Sadar Bazar Police Station, District: Solapur, for the offence punishable under Sections 318(4), 336(3), 337, 338, 340(2), 341(2) of the Bharatiya Nyaya Sanhita, 2023 (for short, "BNS Act"), they be released on executing Personal Bond of Rs.15,000/- each with one surety in the like amount. 10.
Applicants shall attend the concerned police station as and when called by the Investigating Officer.
