By this application filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the applicant seeks anticipatory bail in Crime No.485 of 2025 registered with Vijapur Naka Police Station, District: Solapur for the offences punishable under Section 420 read with Section 34 of the Indian Penal Code (IPC). 2.

Nimbalkar assured that he will provide permanent job to Avinash on condition that he shall pay Rs.10,00,000/- to him. Accordingly, the informant Sangappa transferred an amount of Rs.2,51,000/- in the account of the applicant/accused No.2. Later on, the informant paid Rs.5,00,000/- to Shivanand Nimbalkar for being paid to the said school and for approval from the Government. Shivnand Nimbalkar was demanding remaining amount. The informant Sangappa made inquiry with one Dashrath Khot of the said school and noticed that the applicant/accused No.2 and Shivanand Nimbalkar have cheated him. They accepted Rs.7,51,000/- from the informant Sangappa and used said amount for their own use. On the basis of the same, F.I.R. came to be registered with Vijapur Naka Police Station. 3.
The allegations against the applicant are that by joining hands with her son Shivanand Nimbalkar/accused No.1, she dishonestly induced the informant Sangappa to deliver an amount of Rs.7,00,000/- to her son.

Taking into consideration the fact that the applicant is an old and infirm lady of 78 years age, in the peculiar facts of the case, her custodial interrogation/detention is not warranted. Learned APP on instructions from the Investigating officer, who is present in the Court fairly submits that the informant has no serious grievance against the applicant.

In that view of the matter, the application is allowed by confirming the interim protection granted to the applicant vide order dated 17th December, 2025.

The applicant shall attend the concerned police station as and when called by the Investigating Officer. 7.
The applicant shall not tamper with the prosecution evidence.
