This application is filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 ("BNSS") seeking pre-arrest bail in connection with C.R. No.148 of 2025 registered on 13th May 2025 with the Sangavi Police Station, Pimpri Chinchwad for the offences punishable under Sections 109, 118(2), 118(1), 115(2) 352, 351(3), 189(2), 191(2), 158 and under Section 190 and of
the Bharatiya Nyaya Sanhita, 2023 ("BNS"), under Section 37(1) and 135 of the Maharashtra Police Act, 1951, under Section 25(4) of the Arms Act, 1959 and under Sections 3 and 7 of the Criminal Amendment Act, 2013.

It is the submission of Mr. Pawar, learned Counsel appearing for the Applicant that there are cross complaints. He submits that the Applicant has suffered grievous injuries he is still in the hospital and his conditions is critical.

On the other hand, Ms. Newton, learned APP, strongly opposes the Anticipatory Bail Application. Learned APP disputes the statement made by learned Counsel of the Applicant. Learned APP submits that the offence is very serious and the Applicant is involved in the crime.

Admittedly, the chargesheet has already been filed in subject FIR i.e. C.R. No.148 of 2025. There is a cross FIR i.e. C.R. No.149 of 2025 and the chargesheet is also filed in the said FIR. As the chargesheet is filed, the investigation is completed and therefore the Applicant can be granted Anticipatory Bail.

It is the only contention of Ms. Newton, learned APP that Applicant was absconding. However, the Applicant is in hospital for considerable period. In any case as the chargesheet is filed and the investigation is completed it is not necessary to conduct custodial interrogation.

Accordingly, the case is made out for grant of Anticipatory Bail. In view thereof, the following order is passed:
O R D E R
(a) In the event of arrest of the Applicant- Vaibhav Sanjay Bhosale in connection with C.R. No.148 of 2025 registered on 13th May 2025 with the Sangavi Police Station, Pimpri Chinchwad the Applicant is directed to be released on bail on his furnishing P.R. Bond in the sum of Rs.25,000/- with one or two solvent sureties in the like amount.
(b) The Applicant shall attend the concerned Police Station as and when called.
(c) The Applicant shall furnish his cell phone number and residential address to the Investigating Officer and
shall keep the same updated, in case of any change thereto.
(d) The Applicant shall not directly or indirectly make any inducement, threat, or promise to any person acquainted with the facts of the case so as to dissuade such a person from disclosing the facts to the Court or to any Police personnel.
(e) The Applicant shall not tamper with the prosecution evidence and shall not contact or influence the Complainant or any witness in any manner.
(f) The Applicant shall not leave India without prior permission of the Court.
