Applicants are apprehending their arrest in C.R. No. 459 of 2025 registered with Miraj City Police Station, District: Sangli for offences punishable under Sections 318(2), 318(4), 336(2), 336(3), 338, 339, 340(2), 229(1), 229(2), 233 and 236 of Bhartiya Nyaya Sanhita, 2023.

Prosecution case in short is that, the informant is the President of Shri Jyotirlinga Shikshan Prasarak Sanstha, Khatav, Tal. Miraj. Owing to financial difficulties faced by the said institution, as a result of a loan obtained from DCB Bank in February-2024 for the purpose of expansion, the informant had approached friends in order

to secure additional funds for further expansion of the Institution. On 04.07.2025, the applicants visited the said Institution and provided information about their Company, ASK Investment. They represented themselves as District-Level Representatives of said company and also produced Company identity cards to establish their credentials. They further stated that the company invests in financially distressed borrower institutions and individuals, offering investment returns at the rate of 6% interest for a tenure of ten years. 3.

Heard learned advocate for the applicants, learned APP for the State instructed by the Investigating Officer who is present in the Court. Perused the investigation papers. It appears that accused no. 1 named in the F.I.R. is a real culprit. The applicants were granted interim protection and they have cooperated in the investigation by handing over the documents sought by the Investigating Officer. The offence appears to be pertaining to the documents which are already seized by the Investigating Officer to the extent of applicants. Hence, custodial interrogation of the applicants is not necessary in the facts of the present case.

In the result, the application is allowed. In the event of arrest, the applicants Umesh Alias Anil Sadashiv Gurav and Rohit Dilip Potdar be released on bail in connection with C.R. No. 459 of 2025 registered with Miraj City Police Station, District: Sangli for

offences punishable under Sections 318(2), 318(4), 336(2), 336(3), 338, 339, 340(2), 229(1), 229(2), 233 and 236 of Bhartiya Nyaya Sanhita, 2023 on executing Personal Bond in the sum of Rs. 15,000/- each with one surety each in the like amount. The applicants shall not tamper the prosecution evidence.

The applicants shall attend the concerned police station twice in a week i.e. on every Monday and Thursday between 10.00 a.m. to 2.00 p.m. till filing of the charge-sheet and shall co-operate in the investigation.
