IN THE HIGH COURT OF JUDICATURE AT BOMBAY

CRIMINAL APPELLATE JURISDICTION ANTICIPATORY BAIL APPLICATION NO.2536 OF 2025 Ganpat Babu Gaikwad ... Applicant V/s.

The State of Maharashtra ... Respondent ----- Mr. S. R. Pille a/w Sumeet Gemnani for the Applicant. Mr. P. H. Gaikwad, APP for the Respondent-State. PSI N. B. Gaikwad, Shivaji Nagar Police Station, Ambernath (E) is present. ----- CORAM :

N.R. BORKAR, J.

DATE :

17TH SEPTEMBER 2025 P.C. :

1.

This is an application for anticipatory bail. 2.

Learned APP for the Respondent-State has drawn my attention to the order passed by this Court dated 24th June 2025 in Anticipatory Bail Application No.1319 of 2025 with Anticipatory Bail Application No.1327 of 2025, by which the Applicant was permitted to withdraw the earlier application filed by him for anticipatory bail. The order passed by this Court reads thus:

"

After hearing the matter for sometime, when this Court was not inclined to grant the relief, the learned Counsel for the applicant, on instructions, seeks leave to withdraw these applications. Leave granted as prayed for. The anticipatory bail applications stand dismissed as withdrawn.

2.

As a sequel, the pending interim applications also stand disposed of." Mugdha

Learned Counsel for the Applicant submits that there is a change in circumstance as the prosecution has filed the chargesheet. The submission can not be accepted. In a situation like this, if filing of the chargesheet is treated as change in circumstance, then the concerned accused will abscond after rejection of anticipatory bail and will file fresh application after filing of chargesheet.

4.

Hence, the present Anticipatory Bail Application is rejected. (N.R. BORKAR, J.) Mugdha
